About this file
This is a Justification and Approval (J&A) document for other than full and open competition for federal contract SPRDL1-25-R-0088.
The Defense Logistics Agency (DLA) Land Warren proposes to award a firm-fixed-price contract to Caterpillar Inc. (CAGE 11083) for a Diesel Engine with Shipping and Storage Container (NSN 2815-01-665-3137, part number 57K8952). The engine is used on the M1272 Buffalo Mine-Protected Clearance Vehicle and includes a reciprocating internal combustion diesel engine paired with a reusable shipping and storage container for environmental protection. The contract requires a base quantity of 6 units with an option for 6 additional units, totaling 12 units. The government will use Army Working Capital Funds for this procurement. The justification cites 10 U.S.C. 3204(a)(1) and FAR 6.302-1 as authority, based on the determination that the government does not own the necessary intellectual property data rights to enable competitive procurement from alternative sources, and that reverse engineering the part would be uneconomical. Market research identified four interested sources (MTP Drivetrain Services, Caterpillar Defense, Choate Performance, and Carter Machinery), but none demonstrated the capability to provide an engine and container meeting government specifications. The acquisition method code is 4 (acquire directly from the actual manufacturer), with suffix code R indicating data ownership restrictions. The solicitation will include FAR clauses addressing small business utilization and subcontracting competition. A Sources Sought Notice was posted on SAM.gov from February 25 to March 12, 2025, and the contracting officer determined the anticipated cost to be fair and reasonable based on commercial pricing analysis.
