About this file
This is a Justification and Approval (J&A) document for a sole source procurement of diesel engines from Cummins Power Generation, Inc.
The Defense Logistics Agency Weapons Support (DLAWS) at Warren proposes to award a firm-fixed-price, five-year requirements-type contract to Cummins Power Generation, Inc. (CAGE 4TNW9) for the supply of NSN 2815-01-559-2661 diesel engines (Cummins part number 0100-4046-FRS). The procurement is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 (Only One Responsible Source) because Cummins is the only manufacturer capable of providing engines that comply with form, fit, and function requirements for the Forward Repair System (FRS) without requiring extensive testing and re-engineering work. The Government lacks a Technical Data Package (TDP) to source the part from alternative suppliers, and obtaining or reverse-engineering such data would be uneconomical and result in unrecoverable costs. The good faith estimated quantity is 182 units, with the contract funded through Army Working Capital Funds. Market research identified two responses, including one from MTP Drivetrain Services suggesting remanufactured units, which was deemed infeasible due to the lack of available unserviceable cores for exchange. The solicitation will include FAR clauses 52.219-8, 52.244-5, 52.219-16, and DFARS 252.219-7003 to maximize small business subcontracting opportunities. The approval was authorized on November 20, 2025, by the Competition Advocate for acquisitions greater than $900,000 but less than $20 million.

3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.
Acquisition Method Suffix Code (AMSC):
R - The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part.
5. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
6. Reason for Authority Cited:
a. Background
As authorized by FAR 6.302-1, procurement by other than full and open competition is necessary because a diesel engine furnished by another contractor/manufacturer will require testing and re-engineering work. Cummins Central Power LLC is the current manufacturer of the diesel engine used on the FRS and is the only source that can be used as a direct replacement and comply with form, fit, and functions.
The Government has not completed the screening process and currently does not have a Technical Data Package (TDP) to purchase this part from other than the current source.
The FRS, in its current configuration, was tested using a Cummins Central Power LLC diesel engine.
Re-engineering efforts are estimated to require
The Government would not be able to recover, through subsequent competition, the duplication of cost involved in procuring the data or reverse engineering to increase competition in a reasonable amount of time.
The Government has not completed the screening process and currently does not have a TDP to purchase this part from other than the current source(s).
The Government would not be able to recover, through subsequent competition, the duplication of costs involved with increasing competition within a reasonable time frame.
b. Alternatives: Review of in-house resources was conducted and revealed the item is not available through any Depots or Arsenals. Conducting a competitive acquisition was determined feasible due to the lack of technical data as described above.
c. Impact if not approved: If the Justification is disapproved, the Government would be forced to incur the duplication of costs and unacceptable delay as described above.
7. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in Section 6, the Government is
