About this file
This is a Justification and Approval for Other Than Full and Open Competition (J&A) for a firm-fixed-price contract to procure vehicular axles from Oshkosh Defense, LLC, the approved manufacturer under National Stock Number (NSN) 2530-01-719-1240.
The Defense Logistics Agency – Land Warren (DLA-WRN) seeks to award a contract for non-driving axle assemblies (part number D009U864) used on the M1300 Heavy Equipment Transporter (HET). The contract requires delivery of a base quantity of 5 units with a 100% option quantity of 5 units, totaling 10 units maximum. The contract will be funded through Army Working Capital Funds. The justification cites statutory authority under 10 U.S.C. § 3204(a)(1) and FAR 6.302-1, invoking the "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" exception. Oshkosh is identified as the sole manufacturer possessing the proprietary technical data, design specifications, and manufacturing expertise necessary to produce the axle. The company conducted extensive testing during vehicle development and holds all technical rights and certifications specific to the M1300 HET application. Market research, including a Sources Sought Notice posted to SAM.gov on June 6, 2025 (open 14 days with no responses), and internet searches of commercial axle manufacturers (Cummins, Dexter, DANA/Spicer, Hendrickson) confirmed no viable alternatives exist due to lack of available technical data packages and design compatibility with the M1300 platform. The document references significant reverse engineering costs and extended development timelines that would be required to qualify alternative sources. The contract will include FAR small business subcontracting provisions unless awarded to a small business concern. The J&A was certified and signed by the Contracting Officer on July 21, 2025.

6. Efforts to Obtain Competition:
a. Effective competition: Due to the reasons cited in Section 5 above, the Government is not pursuing competition for this item. Notices required by FAR
5.201 will be posted.
b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns", 52.244-5, "Competition in Subcontracting", 52.219-16, "Liquidated Damages--Subcontracting Plan"," and Defense Federal Acquisition Regulation Supplement 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)", to maximize small business opportunities and utilization.
7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the costs associated with RE reasons cited above. There are no vendors in the process of being qualified for this NSN at this time and none prior to contract award. Currently, there are no current or planned efforts to qualify additional sources since the Government does not possess a fully defined and validated TDP for NSN 2530-01-719-1240. Oshkosh holds the technical data regarding this item.
8. Market Research: A Sources Sought Notice was posted to SAM.gov on 6 June 2025 and was open for 14 days. No responses were received.
The GVSC Tactical Vehicle Sustainment Engineer performed the following internet searches in March 2025 to find suitable competition for the Nondriving Vehicular Axle.
Keywords searched: axle assembly, military axle, HET axle, heavy truck axle.
Websites:
https://www.cummins.com/components/drivetrain-systems/axles https://www.dextergroup.com/products/heavy-duty https://spicerparts.com/parts?category=1 https://www.hendrickson-intl.com/search?ti=product&st=axle
Findings:
Commercial axles offered by Cummins, Dexter, DANA/Spicer, and Hendrickson were reviewed. Without the TDP for the Oshkosh Defense axle, nor the complete TDP for any axle offered by the researched companies, it becomes nearly impossible to ensure compatibility. Axles are identified by characteristics such as weight rating and wheel end hardware, as well as interfaces with suspension and wheel/tire assemblies. The materials, dimensions, mounting details, and performance requirements are not available for this assembly, nor would simply comparing those main characteristics between the existing axle and the researched axles suffice. The axle from Oshkosh has gone through the design process specific to its application on the M1300 HET. Then, SPRDL1-25-R-0204 (JA-01094)

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
This determination will be based on the results of a detailed cost and/or price analysis.
The contractor will not be required to submit certified cost or pricing data as this item has been determined to be a commercial product.
