JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

SPRDL1-25-R-0149

1. Contracting Agency: Defense Logistics Agency - Land Warren (DLA-WRN).

2. Description of Action: DLA-WRN proposes to award a New Firm-Fixed-Price contract to an offeror providing the part of Teradyne, Inc., Commercial and Government Entity (CAGE) 23350, for National Stock Number (NSN) 5998-01-659-7666, Circuit Card Assembly - Precision Analog Test Instrument, using Army Working Capital Funds.

3. Description of Supplies/Services: The NSN 5998-01-659-7666 , part number AI- 762-20 / 13707856-01, Circuit Card Assembly - Precision Analog Test Instrument, is used on the Next Generation Automatics Test Set (NGATS). The deliverable for this contract is for a base quantity of 99 each, with an option quantity of 99 each, making a total quantity of 198 each. The total estimated value of this contract is $ .

3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.

Acquisition Method Suffix Code (AMSC):

H - The Government physically does not have sufficient, accurate, or legible data in its possession to purchase this part from other than current source(s). (NOTE: This code is applicable only to parts under immediate buy requirements and only as long as the deficiency is under review for resolution and appropriate recoding.)

4. Authority Cited: The statutory authority permitting other than full and open competition for this effort is 10 United States Code (U.S.C.) 3204(a)(1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: As authorized by FAR 6.302-1, procurement by other than full and open competition is necessary because no other company has access to the proprietary technical data and test equipment owned by Teradyne, Inc. that is needed to properly produce and test this Circuit Card Assembly, part number 13707856-01.The Government has not completed the screening process and currently does not have a Technical Data Package (TDP) to purchase this part from other than the current source(s).

Teradyne, Inc. owns the proprietary internal design of and all technical data rights for the Circuit Card Assembly. Complete Level III TDPs, suitable for competition, are not available for purchase. The Government has no technical data for the proprietary internal design of each Circuit Card Assembly produced by this vendor. No other companies have access to the proprietary technical data or test equipment owned by the qualified vendor, Teradyne, Inc. The Government does not have any additional information at this time that can be used to compete this requirement, and there is no process underway or funding by which competition can be technically supported in a reasonable amount of time.

To develop the necessary technical data, the Government would need to reverse engineer the subject components, which would not be practicable since there is no funding to qualify a new vendor. There are no vendors currently in the process of being qualified, nor are there current or planned efforts to qualify any additional sources.

Although this procurement will be restricted to the above source, every reasonable effort will be made to obtain potential sources by synopsis and posting to the SAM.gov website.

6. Efforts to Obtain Competition:

a. Effective competition: Due to the reasons cited in Section 5 above, the Government is not pursuing competition for this item. Notices required by FAR

5.201 will be posted.

b. Subcontracting competition: Unless the contract is awarded to a small business, the solicitation and resulting contract will include FAR clauses 52.219-8, "Utilization of Small Business Concerns", 52.244-5, "Competition in Subcontracting", 52.219-16, "Liquidated Damages--Subcontracting Plan", and Defense Federal Acquisition Regulation Supplement 252.219-7003, "Small Business Subcontracting Plan (DoD Contracts)", to maximize small business opportunities and utilization.

7. Actions to Increase Competition: There are no plans to increase competition for future procurements due to the reasons cited above.

8. Market Research: A Sources Sought Notice was posted to SAM.gov on , and was open for 14 days. No responses were received.

In accordance with the tenets set forth in FAR 10.002(b)(2)(vii), market research was conducted by the U.S. Army, Combat Capabilities Development Command – Armaments Center, Rock Island on 18 April 2025. An online search for the words “Circuit Card Assembly - Precision Analog Test Instrument,” “NGATS,” and “NSN 5998- 01-659-7666” was conducted and the results indicated that there are no commercially available products that would meet the known requirements. If technical data, such as drawings with dimensions and performance requirements, were acquired f rom Teradyne, Inc. and converted to Government drawings, the Government would still require vigorous performance and environmental testing to validate a new supplier/manufacturer’s parts. This option would not be cost-effective as described above.

9. Interested Sources: To date no additional sources have expressed interest in this item.
