About this file

This is a Justification and Approval (J&A) document for a sole-source contract award by the Defense Logistics Agency - Land Warren (DLA-WRN) for Transmission Oil Coolers used on the M88A2 Recovery Vehicle. DLA-WRN proposes to award a new Firm-Fixed-Price contract to Tecmotiv (USA) Inc (CAGE 0L7R7) or Renk America LLC (CAGE 02978) for two National Stock Numbers: NSN 2520-01-422-4200 (part number 388010092; E9AR106-003) and NSN 2520-01-424-6732 (part number 388010091; E9AR106-002). The combined procurement includes a basic quantity of 87 units (46 and 41 respectively) with options bringing the total to 174 units. The contract is valued at an undisclosed amount using Army Working Capital Funds. The acquisition is justified under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 (Only One Responsible Source) due to the lack of available Technical Data Package (TDP), proprietary design of the cooler specific to the M88A2 transmission, and Government inability to develop competitive specifications without significant time and expense.

The sole-source justification is supported by market research conducted on August 8, 2024, which identified several commercial oil cooler manufacturers but confirmed the Government cannot determine if commercial-off-the-shelf items meet the space and performance requirements without a TDP. A Sources Sought Notice posted to SAM.gov on November 6, 2024, for 15 days yielded two responses, with only Tecmotiv (USA) Inc providing substantive evidence of capability and manufacturing expertise. Tecmotiv previously supplied 24 units under 2022 contract SPRDL1-23-P-0010 valued at $146,628.24 and committed to a 300-day delivery timeline. The procurement history shows consistent sole-source awards since 2017 to distributors and manufacturers, with no plans to increase competition for future procurements due to the specialized technical requirements and qualification testing that would be necessary for alternative sources.
