Justification and Approval for Other Than Full and Open Competition
1. Contracting Activity: The procuring activity for this action is the Defense Logistics Agency Land – Warren (DLA Land – Warren).
2. Description of Action: This action will be solicited under Request for Proposals (RFP) SPRDL1-19-R-0301. DLA Land - Warren proposes to negotiate a 5 year, long term, firm-fixed-price, IDIQ contract, using AWCF funding.
3. Description of Supplies/Services:

Acquisition Method Code (AMC): 3 - Acquire, for the second or subsequent time, directly from the actual manufacturer.
Acquisition Method Suffix Code: (AMSC): B - This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application.
Although, by DoD-STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained.
4. Authority Cited: The statutory authority permitting other than full and open competition is 10 USC 2304(c) (1), as implemented by FAR 6.302-1, “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Reason for Authority Cited: The customized military-grade Firing Control Communication Processor Circuit Card Assembly (CCA) (P/N: 12491178) is a vital part of the Improved Fire Control Electronics Unit (IFCEU) (P/N: 12388558-5) which is used on the M1A2 System Enhancement Package (SEP) v2 Abrams Tank.
The Technical Data Package (TDP) production specification data is not fully defined because the source controlled drawing 12491178 does not disclose all the information necessary to actually manufacture the Firing Control Communication Processor Circuit Card Assembly (CCA). In fact, the drawing is inadequate for production without access to Curtiss Wright Controls (1BT62) design and procedures.
The Firing Control Communication Processor Circuit Card Assembly (CCA) was developed and tested at Curtiss Wright Controls expense. In addition, Curtiss Wright Controls’s Stable Based Mylars are needed to manufacture the Firing Control Communication Processor Circuit Card Assembly (CCA); however, Curtiss Wright Controls will not release the Stable Based Mylars to their competitiors.
Based on the above information, sole source procurement to Curtiss Wright Controls is the only method of procurement currently available to insure supportability of fielded vehicles.
6. Efforts to Obtain Competition: No vendors are in the process of being qualified at this time, nor will be prior to the contract award.
The Government intends to solicit only from Curtiss Wright Controls based on the rationale provided in paragraph 5 above. The notices required by FAR 5.201 shall be published for this effort, and any bids or proposals received will be considered. There has not been any expressed interest by any known contractors to become a qualified source to produce this Firing Control Communication Processor Circuit Card Assembly (CCA).
To ensure the contractor competitively awards subcontracts to the maximum extent possible, the contract will contain FAR Clauses 52.244-5, “Competition in Subcontracting,” and 52.244- 2, “Subcontracts.” Curtiss Wright Controls will also be required to submit subcontracting plans for review and approval.
Any new vendor who decides to pursue the qualification process will be directed to the Competition Advocate’s Source Approval Program. The Competition Mangement Office (CMP) will encourage interested parties to submit a Source Approval Request (SAR) for future buys.
There has not been any expressed interest by any known contractors to become a qualified source to produce this Firing Control Communication Processor Circuit Card Assembly
(CCA).
7. Actions to Increase Competition: There are no current plans to acquire a competitive TDP because funds are not available to acquire the data necessary to support a competitive acquisition. U.S. Army CCDC Armaments Center engineering estimates that the cost to develop a competitive package for this item through reverse engineering (includes but not limited to the following: identify all the deficiencies, conduct market research on available parts and components, work in conjunction with Curtiss Wright Controls, identify the system’s components and their interrelationships; create representations of the system in another form or a higher level of abstraction; create the physical representation of that system fully define functional parameters, generate a new TDP which would include components complete drawings, performance specifications, and qualification procedures.) could run as high as
Note: This will not be a government funded reverse engineering effort because Curtiss Wright Controls has more than enough customized military grade Firing Control Communication Processor Circuit Card Assembly (CCA) available. Thus, if any contractor decides to take on an effort to reverse engineer and/or procure proprietary data, the new contractor will be solely responsible for taking on all of the cost listed in the above paragraphs.
The information provided in this section 7 is only an estimate of the additional cost associated with reverse engineering; writing the qualification procedures, conducting engineering analysis, Nuclear Hardness and Survivability Testing and qualifying a new source. There is no supporting data provided for this engineering estimate as it is based on engineering judgment and experience.
8. Market Research: On May 22, 2019, ARDEC-Rock Island’s CCDC Armaments Center CMO/Engineer conducted market research by search on Google, IHS Haystack Gold, NSN Now, Ability One, and UNICOR for the customized military Firing Control Communication Processor Circuit Card Assembly (CCA). The online research revealed that the item is not available from distributors or new production sources. NSN Now and IHS Haystack Gold revealed that the item should be acquire directly form the actual manufacturer which is Curtiss Wright Controls. Ability One and UNICOR revealed that the item is not available for procurement.
Based on an inadequate TDP and the engineers overall experience and knowledge of Abrams Fire Control items, it has been determined that no valid alternate, no commercial equivalent or non-developmental item on the market COTS designs are available to meet the Government's requirements.
This item does not appear on the TACOM Warren Competition Advocate’s Shopping List (CASL) or the Advanced Procurement Planning List (APPL), both dated July 2019.
9. Interested Sources: A sources sought synopsis (Notice Number: 2019-249) was posted to FedBizOpps on May 21, 2019, to improve access to acquisition information and to enhance competition by identifying subcontracting opportunities. To date, no responses have been received.

12. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable.
Normal acquisition procedures will be followed to determine that the contract price is fair and reasonable. The appropriate forms of cost and/or price analysis will be utilized, and negotiations will be conducted if necessary. Due to the estimated dollar value, certified cost and pricing data will be required in accordance with FAR 15.403.
