About this file
This is a Justification for Other Than Full and Open Competition (J&A) document for the Defense Logistics Agency (DLA) Land and Maritime for a solicitation to acquire 3 Mechanical Transmissions (NSN 2520-01-574-7228) for Medium Tactical Vehicle Replacement (MTVR) trucks. The transmission is a commercial item sourced exclusively from Oshkosh Defense (CAGE 75Q65), with a procurement history showing previous awards ranging from 1-36 units at unit prices around $58,860-$62,960. The solicitation (SPRAL126R0001) was initiated after a previous small business set-aside procurement (SPRAL125Q0031) failed to attract competitive pricing, and will be synopsized on 10 October 2025 for 15 days. The acquisition is being conducted under FAR Part 12 for commercial items, with a firm-fixed price and no option years, and is justified under 10 U.S.C. 3204(a)(1) as a direct buy from the original manufacturer.
A market survey was conducted from 1-8 October 2025, with only Oshkosh Defense responding and confirming the item's commerciality based on previous Marine Corps determinations. The Marine Corps previously deemed these MTVR component parts commercial in a 2005 letter. DLA Land and Maritime has included procurement note L22 to advise potential offerors about qualifying alternative sources through the design control activity. The agency encourages vendors interested in becoming an approved source to contact the Source Approval Monitor at DSCCAOSAR@dla.mil, demonstrating an ongoing effort to expand potential competition for future procurements despite the current single-source justification.

The use of the authority at 10 U.S.C. 3204(a)(1) is based on:
[ X ] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.
[ X ] AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD- STD-100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained.
If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
On 11 February 2025, the LOGCOM Equipment Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the certification is attached.
6. The following efforts are being taken to ensure that offers are solicited from as many sources as practicable:
[ X ] The acquisition will be synopsized on or about 10 October 2025 for a period of fifteen (15 days).
