About this file

This is a Justification for Other Than Full and Open Competition (J&A) document for Defense Logistics Agency (DLA) Land and Maritime under solicitation SPE7MX-25-R-X021.

The acquisition procures multimeters as spare parts on a non-competitive basis under the authority of 10 U.S.C. 3204(a)(1) and FAR 6.302-1. Two CLINs are involved: CLIN 0001 requests 217 units of NSN 6625-01-509-8205 (Fluke-189IIM/AN multimeter) for the Los Angeles-class submarine (SSN 688), and CLIN 0002 requests 302 units of NSN 6625-01-553-3137 (Fluke-189IIM/AN multimeter) for the DD-1000 Zumwalt-class destroyer. The sole approved source is Fluke Electronics Corp. (CAGE 4U744), designated as the only manufacturer capable of providing form, fit, and functionally interchangeable parts. CLIN 0001 carries AMSC code C due to unique design capability and engineering source approval requirements by the design control activity; CLIN 0002 carries AMSC code Z as a commercial item. The contract structure is indefinite-delivery with a 5-year base period (1 year) plus four 1-year option periods. Market research conducted on March 20, 2025, identified three interested sources: Fluke (manufacturer), Fotronic (1EZE9, small business veteran-owned dealer), and International Television (0EFK4, small business dealer). A Sources Sought notice was posted March 20, 2025, for five business days. The solicitation will be synopsized on August 20, 2025, for one day and posted to the DLA Internet Bid Board System for 30 days minimum. Dealers of the approved source will be solicited. Competition Advocate approval is required as the estimated contract value exceeds $750,000.

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity. Suitable technical data, data rights, or manufacturing knowledge are not available to permit acquisition from other sources and cannot be purchased, developed, or otherwise obtained.

CAGE COMPANY NAME

4U744 FLUKE ELECTRONICS CORP.

The use of the authority at 10 U.S.C. 3204(a)(1) is based on:

CLIN 0001 and 0002 [X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.

CLIN 0001

[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering

FAR 6.302-1 (ONE OR LIMITED NUMBER OF RESPONSIBLE SOURCES)

SOLICITATION NO.: SPE7MX-25-R-X021

DLA Land & Maritime Justification for Other Than Full & Open Competition (February 2025)

Source Selection Information – See FAR 2.101 and 3.104 activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

CLIN 0002

[X] AMSC Z. This part is a commercial/nondevelopmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources are available, AMCs 1 or 2 are valid (When one or a limited number of sources are available, then a J&A is required. When an item is coded with AMSC “Z” and is listed on an interchange catalog or appears on a commercial cross reference list, this constitutes full and open competition, and a J&A is not necessary).

On 3/19/2025, the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the certification is attached.
