About this file

This is a Justification for Other Than Full and Open Competition (J&A) document filed by the Defense Logistics Agency (DLA) Land and Maritime under solicitation number SPE7MX25R0071, dated February 2025.

The acquisition concerns spare parts for Department of Defense valve-managed products for which Griswold Industries (CAGE 86184) and Remote Controls (CAGE 22890) are approved sources. The contract is structured as a 5-year indefinite-quantity contract with a 1-year base period and 4 option years. The solicitation covers approximately 39 NSNs (National Stock Numbers) grouped from a larger population of 1,400+ valve products supporting multiple naval weapon systems including Arleigh Burke-class DDGs, Avenger-class MCMs, Ballistic Missile Defense systems, and various aircraft and auxiliary vessels. The Government restricted this acquisition to one or limited number of responsible sources under the authority of 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, based on the following justifications: 10 items are identified with AMSC C (engineering source approval required by design control activity); 24 items with AMSC D (data not economically available for competitive solicitation); and 5 items with AMSC R (Government lacks data rights and reverse engineering is uneconomical). The Government conducted market research through a Sources Sought Notice issued January 24, 2025, for five business days (yielding no responses) and direct outreach to major valve suppliers including Hunt Valve, Milwaukee Valve, Kampi Components, Transaero, Dante Valve, Ruta Supplies, and others. The Government also posted a second sources sought notice April 29, 2025, to additional companies including Blue Cord Logistics, Griswold Industries, PCX Inc., Remote Controls, BSA Products, and SIT Corporation. Price analysis will be conducted comparing proposed prices to historical pricing, and certified cost or pricing data will be requested as necessary. The solicitation will be synopsized on SAM.gov for 15 days and posted on the DLA Internet Bid Board System (DIBBS) for 30 days. The document includes provisions encouraging vendors to submit Source Approval Request Packages for evaluation as potential alternate sources.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

FAR 6.302-1 (ONE OR LIMITED NUMBER OF RESPONSIBLE SOURCES)

SOLICITATION NO.: [SPE7MX25R0071]

DLA Land & Maritime Justification for Other Than Full & Open Competition (February 2025)

Estimated Base Value: $

Estimated Total Value (Base + Options): $

Maximum Contract Value: $

For Add-Ons, Value of Option Years Remaining: __________________

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by FAR 6.302-1.

5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity.

CAGE COMPANY NAME

see Attachment #1- NSNs.

The use of the authority at 10 U.S.C. 3204(a)(1) is based on:

[X] AMC 1. Suitable for competitive acquisition for the second or subsequent time.

[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.

The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.

[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.

For the 10 items identified with AMSC C, only the approved sources listed in Attachment #1 are currently approved by the design control activity. They are the only known source to possess the requisite rights to technical data for these items and only known approved source(s) for these items.

[X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.

For the 24 items identified with AMSC D, the Government does not have the data or rights to the data, and it is not economical for the Government to obtain or otherwise develop the data. Only the approved sources listed in Attachment #1 possess the complete technical data for these items; therefore, they are the only source(s) uniquely qualified to manufacture these items and the only approved source(s) listed for these NSNs.

[X] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.

For the five items identified with AMSC R, the Government does not have the data or rights to the data, and it is not economical for the Government to obtain or otherwise develop the data for this NSN. . Only the approved sources listed in Attachment #1 are known to own or possess the technical data necessary to manufacture these items and only approved source(s) listed for these NSNs.

On May 7, 2025, the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the certification is located under Attachment #2.

6. The following efforts are being taken to ensure that offers are solicited from as many sources as practicable:

[X] A sources sought notice was issued on SAM.gov. for a minimum period of five business days.

[X] The acquisition will be synopsized on SAM.gov, for a period of 15 days.

[X] Solicitation will be posted on the DLA Internet Bid Board System (DIBBS) for a period of 30 days.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

A price analysis will be conducted based on a comparison of proposed prices received in response to the solicitation and/or a comparison of proposed prices to historical prices paid. Certified cost or pricing data, when required by FAR 15.403-4, and data other than certified cost or pricing data, will be requested and obtained as necessary to establish a fair and reasonable price, and a cost analysis may be performed on the data submitted.

8. Market Research/Efforts to Obtain Competition:

Sources Sought Notice:

[ X ] A Sources Sought Notice was posted to Contract Opportunities on SAM.gov on January 24, 2025, for a period of five business days and yielded the following results: None

The notice was issued in order to seek out and encourage additional sources and vendor participation for a large population (1400+ NSNs) of valve products. The notice stated that it was likely the item would be split into logical groupings for solicitation. This notice included a market research questionnaire and NSN spreadsheet. In addition, drawings were posted for items that have drawings available.

In accordance with DFARS PGI 206.303-2, [X] A copy of the previous justification from contracts SPE7MX21D0003 and SPE7MX21D0105 are located under Attachments #3 and #4.

[ ] A prior justification is not available since all prior acquisitions were under the Simplified Acquisition Threshold.

[ ] The Contract Specialist could not locate the prior J&A for contract __________________.

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief. If not exceeding $750,000, this signature serves as the approval.
