About this file
This is a Justification for Other Than Full and Open Competition (J&A) document under FAR 6.302-1 for solicitation SPE7MX26R0003 issued by the Defense Logistics Agency (DLA) Weapons Support (Columbus).
The acquisition involves an Indefinite-Quantity Contract (IQC) for Department of Defense small arms products and related spare parts supporting multiple helicopter and weapons systems, including HH-60 Pave Hawk, CH-53, MH-60R, MH-60S, OH-58D, CV-22B Osprey, and GAU-21 .50 caliber machine guns, among others. The contract is structured as a firm-fixed-price arrangement with a five-year total length comprising a three-year base period and two option years. FN Herstal (CAGE B0897) is designated as the sole approved source for substantially all items, with Sikorsky Aircraft Corporation (CAGE 78286) listed as an alternate approved source for one specific NSN (1005016981072). The justification cites AMSC codes C, D, and R, indicating that items require engineering source approval, possess proprietary technical data not economically available to the Government, and cannot be competitively acquired due to data restrictions and lack of alternate qualified manufacturers.
Market research efforts included a sources sought notice posted to SAM.gov from September 16-27, 2025, which yielded no competing responses, and a market survey that confirmed FN Herstal's willingness to pursue the contract. The document notes that most prior acquisitions fell below the Simplified Acquisition Threshold; one NSN (1290131229035) references a previous justification under contract SPE7M9-25-C-0001. The contracting officer determined that anticipated costs will be fair and reasonable based on price analysis of proposed offers and historical pricing comparisons.

4. The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by
FAR 6.302-1.
5. The Government requires spare parts that are form, fit, and functionally interchangeable with those currently used on the supported end item or weapon system. The acquisition is restricted to the following source(s) of supply, which are the only source(s) known to have the capability of furnishing the required supplies and the only source(s) currently approved by the design control activity; refer to Attachment #1. For NSN 1005016981072, the only approved sources by the design control activity is Sikorsky Aircraft Corporation (78286) and FN Herstal (B0897). For all remaining NSNs, the sole approved source is FN Herstal (B0897).
The use of the authority at 10 U.S.C. 3204(a)(1) is based on:
[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The following AMSC descriptions are available in DFARS PGI 217.7506 Part 2.
[X] AMSC C. This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.
For NSN 1005131221985, only FN Herstal (B0897) is currently approved by the design control activity. They are the only known source to possess the requisite rights to technical data for this item and only known approved source for this item.
[X] AMSC D. The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.
For the NSNs identified with AMSC D, the Government does not have the data or rights to the data, and it is not economical for the Government to obtain or otherwise develop the data. Only the approved sources possess the complete technical data for these items; therefore, they are the only source uniquely qualified to manufacture these items and the only approved source(s) listed for these NSNs. For NSN 1005016981072, there are two approved sources: Sikorsky Aircraft Corporation (78286) and FN Herstal (B0897). FN Herstal has been the sole supplier of this NSN to the Government. For all remaining NSNs, FN Herstal (B0897) is the sole approved source.
[X] AMSC R. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture this item, AMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture this item, AMCs 1 or 2 are valid.
For the three items identified with AMSC R, the Government does not have the data or rights to the data, and it is not economical for the Government to obtain or otherwise develop the data for these NSNs. FN Herstal (B0897 is the only known source to possess the technical data necessary to manufacture these items and only approved source listed for these NSNs.
On September 15, 2025, the Product Specialist of record certified the accuracy of the approved source(s) and applicable AMC/AMSC codes. A copy of the technical certification is located under Attachment #2.
6. The following efforts are being taken to ensure that offers are solicited from as many sources as practicable:
[X] A sources sought notice was issued on SAM.gov. for a minimum period of five business days.
[X] The acquisition will be synopsized on SAM.gov, for a period of 15 days.
[X] Solicitation will be posted on the DLA Internet Bid Board System (DIBBS) for a period of 30 days.
7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. A price analysis will be conducted based on a comparison of proposed prices received in response to the solicitation and/or a comparison of proposed prices to historical prices paid. Certified cost or pricing data, when required by FAR 15.403-4, and data other than certified cost or pricing data, will be requested and obtained as necessary to establish a fair and reasonable price, and a cost analysis may be performed on the data submitted.
8. Market Research/Efforts to Obtain Competition:
Sources Sought Notice:
[ X ] A Sources Sought Notice was posted to Contract Opportunities on SAM.gov from September 16, 2025, to September 27, 2025. This notice included a market research questionnaire and NSN spreadsheet. This notice yielded the following results: None.
[ ] A waiver of the Source Sought Notice was approved by the HCA or designee on __________________ and is hereby attached.
Market Survey:
On September 16, 2025, a sources sought notice was issued for seven days on the SAM.gov website in order to seek out and encourage additional sources. This notice included a market research questionnaire and NSN spreadsheet. An email was also sent to FN Herstal (B0897). The market survey asked for information such as willingness to quote a three-year base period and priced option years, provide stock delivery, state if the items are quantity sensitive, and state if the items are commercial. A response was received from FN Herstal on September 25, 2025.
