Justification for Other Than Full and Open Competition - SPE7MC24R0026

This document is a Justification for Other Than Full and Open Competition (J&A) prepared by the Defense Logistics Agency Weapons Support (Columbus) for the acquisition of valve assembly manifolds under solicitation SPE7MC24R0026.

The contracting activity seeks to acquire five (5) valve assemblies for the ARLEIGH BURKE CLASS DDG weapons system under a firm-fixed-price contract on a non-competitive basis. The acquisition is restricted to Marotta Controls Inc. (CAGE 99657), identified as the sole source known to possess the capability and design approval for furnishing parts that are form, fit, and functionally interchangeable with those currently used on the supported end item. The statutory authority cited is 10 U.S.C. 3204(a)(1), implemented via FAR 6.302-1, with the specific AMSC code designation of "R" (government does not own manufacturing data or rights). Market research was conducted from September 10-26, 2024, contacting Marotta Controls and Begini Howard Private Equity (BHPE) LLC; only Marotta Controls responded. A Sources Sought Notice was posted on SAM.gov on September 10, 2024, for ten business days with no additional vendors expressing interest. The anticipated cost to the government will be determined through price analysis comparing proposed and historical prices. The solicitation will be posted to the DLA Internet Bid Board System for a minimum of thirty days, and pricing information and certifications were obtained on October 16, 2025. The justification was signed by Contracting Officer Rich Amy Charlene and approved by Competition Advocate William Melendez on October 23, 2025.
