About this file
This is a Justification for Other Than Full and Open Competition (J&A) for federal procurement solicitation SPE7LX-25-R-0050 issued by the Defense Logistics Agency (DLA) Land and Maritime.
DLA seeks to acquire supplies on a firm-fixed-price, indefinite-delivery, indefinite-quantity contract basis for a five-year period (three-year base plus two one-year options) from RENK AMERICA (CAGE: 02978), the sole approved source. The acquisition covers four line items totaling parts for the M88A2 Heavy Equipment Recovery Combat Utility Lifting Extraction System (HERCULES) and the AVDS-1790 diesel engine: Piston Internal Com (1,044 units annually); Ring Set Piston (1,234 units annually); Filler Neck Vehicle (63 units annually); and Cross Tube (60 units annually). All items have weapon system code ZLA (Recovery Vehicle Full) and are classified as commercial items. The solicitation will be posted to the DLA Internet Bid System (DIBBS) around July 7, 2025, for a 30-day response period.
The J&A justifies single-source procurement under 10 U.S.C. 3204(a)(1) citing limited sources, with RENK America identified as the only source possessing necessary technical data and manufacturing knowledge. Market research conducted March 13 to April 10, 2025, contacted four vendors; three responded (EOS Inc., Brighton Cromwell/Triman, and RENK America), with only RENK confirming its OEM status. A Sources Sought notice posted March 13-28, 2025, yielded no additional responses. Cost and pricing data are not required as items are deemed commercial. The anticipated contract value exceeds $15,000,000, requiring Head of Contracting Activity approval. The contracting officer certified cost reasonableness on August 21, 2025, with competition advocate and HCA approval also dated August 21-22, 2025.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOLICITATION SPE7LX-25-R-0050
4. The statutory authority permitting for other than full and open competition is:
[X] 10 U.S.C. 3204(a)(1) - Available from only one or a limited number of sources.
5. If restricted to the only source(s) of supply, include source(s) and CAGE code:
RENK AMERICA (CAGE: 02978)
The use of the authority cited below:
[X] AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The use of the authority cited is based on:
[X] AMSC C (1 NSN). This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part from the approved source(s). The approved source(s) retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, AMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, AMCs 1 or 2 are valid.
[X] AMSC D (3 NSNs). The data needed to acquire this part competitively is not physically available, it cannot be obtained economically, nor is it possible to draft adequate specifications or any other adequate, economical description of the material for a competitive solicitation. AMCS 3, 4, or 5 are valid.
For those items that are coded with an AMSC of C, the listed sources are the only companies at the current time that have gone through the source approval process to have their part numbers approved for these NSNs. The approved sources retain data rights, manufacturing knowledge, or technical data that are not economically available to the Government. Any company offering products other than those approved would need to get their part numbers approved.
For those items that are coded AMSC D, the listed sources are uniquely qualified because they are the only sources that own the data or data rights necessary to manufacture the items. Additionally, the data needed to acquire these items competitively is not available.
In accordance with FAR 6.303-2(c) and FAR 6.303-2(b)(5), the following provides a demonstration of the unique qualifications of the sources listed above to justify the use of 10 U.S.C. 3204(a)(1). On February 11, 2025, , certified that the technical information, including the AMC/AMSC codes are complete and accurate. (See Attachment 1- Tech Cert CL25041001)
6. Efforts to ensure that offers are solicited from as many sources as practicable are:
Market Research efforts are detailed in Section 8.
A Sources Sought notice, which included a market survey, that was posted to SAM.gov website from March
13, 2025, to March 28, 2025, with no response received.
The acquisition was synopsized on June 9 for a total of 15 days.
Based upon the technical certification on file in DLA Land and Maritime VEP technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.
11. The following actions are being taken to identify additional sources:
Solicitation contains DLA Procurement Note, L04 Offers for Part Numbered Items Solicitation contains DLA Procurement Note, M06 Evaluation of Offers for Part Numbered Items At this time, the requirement/guidance in DFARS PGI 206.304 has been fulfilled.
12. J&A for previous Lont-Term Contract is attached. (See Attachment 3 – Previous JA SPE7LX20R0137
