About this file
This Justification for Other Than Full and Open Competition (J&A) document is for a solicitation (SPE7LX-25-R-0013) by the Defense Logistics Agency (DLA) Land and Maritime to acquire pneumatic vehicle tires for the Heavy Expanded Mobility Tactical Truck (HEMTT). The solicitation is for a three-year, firm-fixed-price requirements long-term contract with Michelin North America as the sole approved source. The specific tire is the Michelin X Force Winter Tire, NSN 2610-01-722-4183, which was developed specifically for military tactical wheeled vehicles and requires engineering source approval to maintain quality and ensure form, fit, and functional interchangeability.
The contract is being pursued under 10 U.S.C. 3204(a)(1), which allows non-competitive procurement when supplies are available from only one responsible source. Market research, including a Sources Sought notice and survey, confirmed Michelin is the only source capable of providing these specialized tires. The estimated total contract value is $25,420,507.50, with Michelin being the only vendor possessing the necessary technical data rights and manufacturing capabilities to meet the military's specific requirements. The contract will support the Global Tires Program (GTP) and provide direct supply support to the government for ground tires compliant with Society of Automotive Engineers standards.

CUI
A contract resulting from this solicitation will provide supply support to the GTP contractor pursuant to FAR Part 51 and may provide direct supply support to the Government.
The Federal Supply Group (FSG) for this NSN is 26 (Tires and Tubes), which represents the commodity class of the item.
The Acquisition Method Code/Acquisition Method Suffix Code (AMC/AMSC) for this NSN is either 3/B.
The proposed action for the solicitation and award of a three (3) year, Firm Fixed Price (FFP) Requirements Long-Term Contract (LTC). The contract(s) would consist of one three-year base period with no options. The estimated contract values are listed above.
4. The statutory authority permitting other than full and open competition is:
10 U.S.C. 3204(a)(1)
(a) The head of an agency may use procedures other than competitive procedures only when-
(1) The property or services need by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services with satisfy the needs of the agency.
5. The Government requires tires that are form, fit and functionally interchangeable with those currently used on the HEMTT. These tires require engineering source approval by the design control activity to maintain the quality of the part.
The use of Brand Name or Equal cannot be utilized to maximize competition as these tires are required to be tested and approved in accordance with SAE J2014 for military tactical wheeled vehicles.
The tires can only be purchased from the approved source for this tire. The approved source is the only known source with the data or data rights necessary to manufacture this tire to meet the military customer requirements, and ensure form, fit and function interchange with the tires currently on the supported vehicles.
The use of the authority cited in other than 10 U.S.C. 3204(a)(1) above:
AMC 3. Acquire, for the second or subsequent time, directly from the manufacturer.
The use of the authority is based on:
AMSC B. This part must be acquired from a manufacturing source(s) specified on a source control or selected item drawing as defined by the current version of DoD-STD-
100. Suitable technical data, Government data rights, or manufacturing knowledge are not available to permit acquisition from other sources, nor qualification testing of another part, nor use of a second source part in the intended application. Although, by DoD-STD- 100 definition, altered and selected items shall have an adequate technical data package, data review discloses that required data or data rights are not in Government possession and cannot be economically obtained. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid. For the NSN listed above with an AMSC of B, Michelin is the only approved manufacturing source and is the only known source to possess the requisite rights to the technical data for this item.
