About this file

This is a Justification for Other Than Full and Open Competition (J&A) for Solicitation SPE7LX-24-R-X033 issued by the Defense Logistics Agency (DLA) Land and Maritime. The procurement seeks to acquire two National Stock Number (NSN) items: a plain enclosed seal (NSN 5330-01-247-2764) and a seal replacement parts kit (NSN 5330-01-377-2460), both supporting the Truck Tractor, Armor and Patriot Missile systems. The contract will be a five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract with a three-year base period and two one-year option periods.

Market research was conducted from March 30 to July 1, 2024, targeting seven sources, with only two vendors (Triman Industries and HDT Vehicle Component Sales) responding to the survey. The solicitation will be synopsized for 15 days and then posted on the DLA Internet Bid Board System (DIBBS) for 30 days. The government determined there is no reasonable expectation of receiving multiple offers from small businesses. The items are considered commercial and will be procured using FAR 13.5 Simplified Procedures, with approved sources including Federal-Mogul Corporation, Brighton Cromwell LLC, Parts Life Inc., Oshkosh Defense LLC, and Haldex Brake Products Corporation.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7LX-24-R-X033

, Product Specialist, certified that the technical information, including the

AMC/AMSC codes are complete and accurate. In accordance with FAR 6.303-2(c)(1)(ii)(B) and FAR 6.303-2(b)(5), the preceding provides a demonstration of the unique qualifications of the sources listed above to justify the use of 10 U.S.C. 3204(a)(1).

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

The acquisition will be synopsized for 15 days before the solicitation is published.

At the completion of the synopsis period, the solicitation will be posted on the internet via the DLA Internet

Bid Board System (DIBBS) for a period of 30 days.

On the day that the solicitation is posted to DIBBS, a copy of the solicitation will be emailed to the approved sources for these NSNs.

Dealers of the approved sources will be solicited.

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable. Cost or pricing data in accordance with FAR 15.403-4 will not be required as these items are commercial. The buyer will utilize price analysis as well as previous past history, PPI, and learning curve analysis to establish Government Targets.

Additionally, comparison to commercial catalogs and part numbers are available on the internet and/or informal cost breakdowns will be used to make a price reasonable determination. By using the above techniques, the Contracting Officer anticipates that the costs to the Government will be fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

Market Research was conducted from March 30, 2024, to July 1, 2024. A total of seven (7) sources including manufacturers and dealers from the procurement history were sent market surveys: Wheeler Fleet Solutions (55683), HDT Vehicle Component Sales, Inc. (1SER6), Statz Corporation (3WGD1), Oshkosh Defense LLC (75Q65), Drive Line Inc. (0GE52), RITS LTD. Brokers, Inc. (3DR29), and Brighton Cromwell (3NNX8) now Triman Industries

(0ZBE8).

A Sources Sought was published to SAM.gov on Nov. 13, 2023 – Nov. 20, 2023, a second Sources Sought was posted on Jan. 17. 2024 – Jan. 24, 2024, and a third Sources Sought was published July 1, 2024 – July 14, 2024, due to the lapse in time from the original postings. No responses were received from any of the Sources Sought published.

Two (2) out of seven (7) vendors responded to the market survey.

Based on this information, the buyer has determined there is no reasonable expectation of receiving two or more responsible offers from small businesses offering the material from at least one small business concern.

The Government sent a market survey and received responses from the following two (2) vendors:

1. Triman Industries (0ZBE8)

2. HDT Vehicle Component Sales (1SER6)

9. Additional facts supporting other than full and open competition are:
