4. Authority Cited: This acquisition is being conducted under the authority of Federal Acquisition Regulation (FAR) 6.302-1(a) and FAR 6.303-2.
5. Reason for Authority Cited: The State of Utah’s Fuel Network is responsible for the maintenance of all state-owned underground storage tanks, ensuring that all federal, state, and local laws and regulations are complied with. The State of Utah Fuel Network is a Legislature approved fuel network to ensure the best cost savings. The UTARNG is a State Entity that belongs to a State Network, mandated by the State of Utah Legislature. Fuel costs at State operated facilities are always a fixed rate-based Fuel Network purchase price, thus ensuring the best cost savings.
The Fuel Site at Camp Williams is located on State of Utah property and the UTARNG has been partnering with the State of Utah Fuel Network for over 25 years.
The State of Utah charges a $0.24 per gallon surcharge rate which covers all repairs, maintenance, and site operations of the State managed tanks. Continuing our partnership with the State of Utah Fuel Network precludes additional costs for repairs, maintenance, and site operations for the fuel tanks. This service also covers electronic State of Utah monitoring and inventory control system EKOS to manage the fuel levels. This eliminates the manual dip-stick method to estimate fuel levels and eliminates purchasing additional electronic monitoring and inventory control system.
Any provider other than the State of Utah Fuel Network would cause substantial costs to replicate what is already existing at Camp Williams. Additionally, such costs would not be expected to be recovered through competition and would also cause unacceptable increased delays in fulfilling the UTARNG’s requirements.
6. Efforts to Obtain Competition: The State of Utah is approved as Local Purchase Authority from Defense Logistics Agency (DLA) to supply bulk fuel to State managed tanks. Competition for this requirement will not be pursued.
