About this file

This document is a Justification & Approval for Sole Source procurement under FAR Part 13.501 for temporary facilities at Camp Murray. The contract modification is for the 194th MSG/MSC, involving an 8-month extension of a trailer-style office building with a tear-down option, totaling $62,871.00. The temporary facilities are for the Air Support Operations Group (ASOG) administrative space while awaiting completion of a new complex building, which has been delayed by two years. Market research indicates that switching providers would increase costs by approximately eight times, as setup and tear-down expenses account for 85% of a new facility's contract value. Previous contract actions include W912K318F6001 awarded in February 2018 for $425,874.12 and W50S9E20F0012 awarded in August 2020 for $62,187.12, initially competitively solicited to 22 GSA vendors.

Sole Source Justification and Approval Under FAR 13.501

1. Contracting Activity: 194th MSG/MSC

2. Description of Action: Modification to a firm fixed price contract for previously installed temporary facilities located on Camp Murray meant to allow for allotted base square footage until completion of the ASOG Complex building estimated to be completed in Dec.

3. Description of Supplies/Services: Increase period of performance by 3 months for temporary trailer style office building space for 8 months, and required tear down option for a total of $62,871.00.

4. Authority Cited: 41 U.S.C. 1901 as implemented in FAR 13.501(a)(1)(ii), sole source (including brand name) under the authority of the simplified procedures for certain commercial items.

5. Reason for Authority Cited: The temporary facilities are a commercial commodity previously installed on Camp Murray. Setup cost and tear down cost for temporary facilities is substantially more than the monthly lease amount for the building. The government would only incur these costs by switching to another company which would still serve the same purpose without added benefit or advantage, and significantly increase costs to the government.

6. Efforts to Obtain Competition: Competition from other providers for temporary facilities exists in the market, however there are none with pricing that will compete with the decreased cost of the incumbent, because they do not have to play for a trailer installation fee.

7. Actions to Increase Competition: The original acquisition was competitively solicited to a pool of vendors available on GSA. This is for the Air Support Operations Group administrative space requirements which is temporary until their building is constructed.

The base was approved by NGB to have temporary facilities until the construction is completed. The construction has been delayed by two years which is why this is only for two additional years. Should a new temporary facility requirement materialize, a new competitive solicitation would be accomplished. Increased competition would not alleviate the unnecessary cost burden for this requirement.

8. Market Research: Market research shows that the cost of tear down, followed by delivery, installation and setup of a new temporary facility would account for 85% of the cost of a new contract for similar facilities. Soliciting for a new facility would most likely result in costs eight times higher than to continue with the current facilities which meet the governments need.

9. Interested Sources: N/A

10. Other Facts: The temporary facilities were meant to serve for a limited time until the completion and furnishing of the new ASOG Complex building on Camp Murray due to the need for square footage based on personnel assigned. The project has slipped from its original projected start and completion time due to factors outside the Government’s control. The temporary facilities are still needed until such time that a new building with adequate space can be occupied.

a. Procurement history.

(1) Previous history of acquisitions: W912K318F6001 awarded 15 Feb 2018 for $425,874.12 and W50S9E20F0012 awarded 31 Aug 2020 for $62,187.12.

(2) The first contract action was competitively solicited to 22 vendors from a GSA IDIQ. The second contract was part of a novation agreement and with the company that acquired the previous vendor.

11. Fair and Reasonable Cost Determination:

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on historical pricing and that certified cost or pricing data is not required per FAR 15.403-1(b)(3).

I certify that this justification is accurate and complete to the best of my knowledge and belief.
