Other Than Full and Open Competition

1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration – Program
Contracting Activity
2. Nature and/or Description of the Action Being Approved: The action being reviewed is for the procurement an Elevator Subject Matter Expert (SME) to develop and standardize documentation to be utilized for elevator modernization throughout the entirety of the VA. This is a new requirement that will result in a firm-fixed-price contract.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: The Department of
Veterans Affairs (VA) operates a large portfolio of medical centers and outpatient facilities nationwide, many of which require elevator modernization. To streamline delivery and ensure consistency, the VA plans to establish a nationwide contracting vehicle for elevator modernization projects. To support this effort, the VA requires specialized elevator subject matter expert (SME) support to develop a standardized Elevator Modernization Manual and provide limited technical consultation services. The purpose of this engagement is to establish streamlined, consistently repeatable standards and expectations for elevator modernizations, and ensure compliance with applicable codes and VA vertical transportation requirements. The total estimated value of this proposed action is . The estimated Period of Performance is 120 days after the Notice to Proceed (NTP).
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by RFO 6.103-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7008 (DEVIATION) or VAAR
819.7009 (DEVIATION)- up to $5,000,000. Check the specific VAAR clause used below:

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The proposed source for this acquisition is FFE ENVIRONMENTAL SERVICES INC., a registered and verified service-disabled veteran-owned (SDVOSB), located at 4445 Lake Forest Dr, Suite 600, Blue ASH, OH 45242. FFE is technically qualified for this project as they currently hold one of PCAC’s A-E MATOCs, where their capabilities were determined prior to award. A review of the Contractor Performance Assessment Reporting System (CPARS) has confirmed FFE’s successful past performance on VA projects. The VA’s technical experts have determined that FFE is the most qualified to perform on the required services as they possess all knowledge regarding this project. The authority allows sole source awards to SDVOSB/VOSB based on 38 U.S.C. 8127(c) and the SDVOSB/VOSB concern has been determined to be a responsible source with respect to performance.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by RFO 6.301 and, if not, which exemption under RFO 5.101(b)(1) applies:
A review of the 19 MATOC holders and their capabilities were conducted prior to the award of the MATOC. It was determined that of the 19, two were of the utmost qualified. When comparing the two most qualified, FFE determined to be more capable and possessed more knowledge of the requirements of the scope of work. All firms additionally have Vertical Transport Engineers as it pertains to VA vertical transportation requirements.
The Justification and Approval (J&A) document will be posted within 14 days after award in accordance with FAR Subpart 6.305. The award synopsis will be posted to GPE in accordance with FAR Subpart 5.301(a)(1).
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable and is in overall best interest of the Government. The basis for this determination is that the price of the awardee will be determined fair and reasonable prior to award by reviewing the price of similar acquisitions in comparison to the government’s Independent Government Cost Estimate (IGCE). Additionally, the rates proposed will be compared to all already established PCAC A-E MATOC rates with FFE.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Market Research was conducted for the creation of the MATOC IDIQ in which all 19 vendors were found prior to having their contracts established.
Additionally, all 19 confirmed and capable vendors participated in discussions / conferences on 10/22/2025 at the PCAC office to discuss the overall MATOC. Additionally, the COR was consulted as a knowledgeable individual within Government regarding the market capabilities in order to meet the requirement.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None. The authority allows sole source awards to the SDVOSB based on 38 U.S.C. 8127(c).
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: The Office of Healthcare Engineering VISN 23 – Minneapolis VAMC and VHA PCAC will compete future projects on the open market using the procedures established in FAR Subpart 36.6 for AE procurements.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, VHAPG Part 819.7008/7009 Sole Source Awards to SDVOSB/VOSB Page 3 of 3
Effective Date: 12/15/2025 which are included in the justification, are accurate and complete to the best of my knowledge and belief.
