About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a sole source contract to provide curatorial services to store and manage a government-owned paleontological collection.
The contract is a new requirement with a total estimated value of $23,295 over one base year and four option years. The contractor will provide curatorial services such as storage and management of 107 paleontological specimens, as well as associated archival records, photographs, and data. The authority cited is 10 U.S.C. 2304(c)(1) and FAR 6.302-3(a)(2)(ii) to maintain an essential engineering, research, or development capability. A notice of intent to award a sole source contract was posted on SAM.gov, but no other sources expressed interest. The University of Colorado Boulder is the only qualified source due to requirements in 36 CFR 79 for the repository. A fair and reasonable cost determination was made based on an independent government estimate and the University's historical pricing.

From time to time, new materials may be added to the collection or existing portions of the collection may be removed; a contract modification shall be necessary to document the addition of new materials to or removal of materials from the collection and account for the curatorial services rendered that may include accession or deaccession fees. Regarding data contained within the collections archival records, specific locality data of paleontological site will not be released to the public. 4. Authority Cited: The statutory authority permitting this procurement is 10 U.S.C.

7. Actions to Increase Competition: Outside of posting the Notice of Intent to Award a Sole Source Contract requirement on SAM, there have been no attempts or plans to increase competition for services that must be completed per guidelines and restrictions dictated in the Code of Federal Regulation (CFR). The reasons behind this decision have been previously outlined in paragraph 5.
This requirement was previously awarded in FY20. The only Offeror for that requirement was the University of Colorado Boulder. No other entities expressed interest in the requirement or made any offers to perform the work.

9. Interested Sources: To date, no other sources have written to express an interest.
The notices required by FAR 5.201 shall be published, and that any bids or proposals received shall be considered.
10. Other Facts: The U.S. Army Corps of Engineers will continue to perform Market Research, in an attempt to identify alternatives to avoid sole source situations in the best interest of the Government.
Currently, based upon the Code of Federal Regulations, the University of Colorado Boulder must be utilized for this requirement. See Paragraphs 3, 5, and 6 above.
