VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Single Source Justification for SAP under the SAT

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C246-23-AP-2540

1. Contracting Activity: Department of Veterans Affairs, VISN 06, Hampton VA Medical Center, PR#

590-23-2-985-0187

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The Hampton VAMC Pharmacy requested the Polysomnography Sleep Lab System from Nihon Kohden Polysmith (PS)12 Sleep Sense System and associated software and installation for the facilities replacement of the existing equipment.

The estimated cost of this procurement is $157,930.00

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Nihon Kohden America, Inc. is the original equipment manufacturer for this equipment. They are the only vendor capable of providing equipment that already has TRM and ERA certification/approval, and utilizes smart cables which automatically detect, display, and measure associated parameters. Polysmith 12 software is proprietary to Nihon Kohden America, Inc. and cannot be purchased from another vendor.

4. Description of market research conducted and results or statement why it was not conducted:

Market Research was conducted seeking qualified vendors that are capable and able to meet this requirement. A search on FPDS for recent awards contracts were awarded to the OEM (Nihon Kohden) and sole sourced to the SDVOSB authorized to distribute the equipment. The OEM states that they have only one SDVOSB as their only authorized distributor. After Action Medical and Dental Supply, LLC is the identified SDVOSB.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
