I. Contracting Activity.
AFMETCAL/WNMK, 813 Irving Wick Drive West, Heath Ohio 43056-1199.
II. Nature and/or description of the action being processed.
This J&A is for a new sole source, firm-fixed-price commercial contract to procure load cells and digital indicators. The proposed contractor is Tovey Engineering Inc. (Tovey). The projected period of performance is 5/1/2021-9/2025
III. Description of supplies/services required to meet agency needs.
CS10-2.5K-B300: Quantities to be purchased are 32 units from FY21-25 using 3080/Investment funds at a total estimated price of . Only 12 units are being purchased the first year, remaining units are option quantities that will be purchased if funding becomes available.
CS10-10K-B300: Quantities to be purchased are 36 units from FY21-25 using 3080/Investment funds at a total estimated price of Only 16 units are being purchased the first year, remaining units are option quantities that will be purchased if funding becomes available.
9150-2-300: Quantities to be purchased are 20 units from FY21-25 using 3080/Investment funds at a total estimated price of . Zero units are being purchased the first year, units are option quantities that will be purchased if funding becomes available.
Production Delivery will be at a rate of 5 to 40 total units per month.
IV. Statutory authority permitting other than full and open competition.
10 USC 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) Part 6.302-1(a)(1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, and required by FAR 6.303-2(b)(4).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The Tovey C3-100 Automated Vertical Force Press, CS Series Load Cells, and 9150 Digital Indicators were originally procured under FA2263-11-C-0002. This procurement process was completed without a sole source or limited source procedure.
New Tovey CS10-2.5K-B300, CS10-10K-B300 load cells and 9150-2-300 digital indicators are needed to replace current CS10-2.5K-B300, CS10-10K-B300 load cells and 9150-2-300 digital indicators that are damaged beyond repair. These items shall have the same capabilities and specifications as the load cells and digital indicators currently in the Air Force Force Exchange Kit inventory that were procured under FA2263-11-C-0002.
The Tovey CS Series load cells serve as the base reference standards for force measurements in the Air Force. The load cells and indicator are designed to interface exclusively with the Tovey C3-100 Automated Vertical Force Press which is located at 31 PMELs. The C3-100 utilizes software to provide faster calibrations. Proper configuration between the C3-100 software, C3-100 hardware, load cells, and indicator are required for the system to perform. It involves proprietary technology and software which the manufacturer is unwilling to release to another company. Procuring load cells and indicators from another manufacturer would make the C3-100 useless.
AFMETCAL owns an additional 50 load cell kits to support the remaining 34 PMELs and the exchange program.
Procuring a relatively small number of load cells and indicators from another manufacture would introduce unnecessary configuration control issues to the calibration program and to the support of the force measurement area.

Full and Open competition would result in a duplicated cost to the Air Force of:

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
AFMETCAL Contracting and Small Business Representative-issued Sources Sought Synopsis with draft PD was posted on March 3, 2021; 1 response was received Chant Engineering. Chant Engineering cannot meet the Air Force requirement due to the compatibility between the the C3-100 Automated Vertical Force Press and the load cells. Based on the results of this market research, the AFMETCAL determined there is no vendor, other than Tovey, able to meet Air Force requirements.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
A cost analysis will be performed to determine if the proposed amount is fair and reasonable. Price analysis will be used to verify the overall price offered is fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As described in Section VI of this document, market research, IAW FAR Part 10, was conducted by synopsis to advise industry of the proposed acquisition and to solicit inquiries from interested parties. Based on the results of this market research, the Air Force Technical Team determined that the Tovey equipment provides the best value to the government and no other vendor besides Tovey was found to be able to perform the upgrade as described in this Justification and Approval.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
The component items are COTS items, so delays in delivery are not expected.
X. List of any sources that expressed, in writing, an interest in the acquisition.

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Tovey is the manufacturer of the original system. It involves proprietary technology and software which the manufacturer is unwilling to release to another company. For this requirement there is no other action that can be accomplished to generate competition without a substantial duplication of costs. This procurement will provide the best value to the Government at this time. A sole source effort is required for the base quantities and option years to
March 2018 FOR OFFICIAL USE ONLY Page 4 of 4 prevent significant downtime and increased calibration costs due to proprietary data involved with the upgrade. We will continue to monitor the market place to see if other viable vendors become available.
