FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: 151 MSG/MSC
2. Description of Action: The 151 CES requests a contract with Atkins North America.
The Government projects award for 2022 and fiscal year 2022, SRM funds will be used.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207 .103( d)(i)(B).
3. Description of Supplies/Services:
A-E Type C construction oversight services to include submittal review, drawing/specification interpretation, and inspection. Task order W50S9A-20-F-0003 was a competitive A-E selection awarded from IDIQ W9133L-16-D-0008 and included an option for Type C services; however, the time passed for proper exercising of the option.
The construction effort associated with the completed design has now been funded and these oversight services are critical to ensuring the construction is completed in accordance with the design specifications.
Period of Performance: 8 August 2022 to 8 February 2023 Total Value:
4. Authority Cited:
10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited:
This Architect-Engineer firm designed the project and these services were negotiated as an option on the original contract, but those options expired due to expiration of the IDIQ contract and additional time required to design. These services require the A-E to interpret or clarify the intent of the plans and specifications, which would be extremely difficult for an A-E other than the designer of record. There would be significant liability and schedule risk in a different A-E taking on this responsibility. As part of their responsibilities under the design contract, this A-E firm is responsible for correcting any errors or deficiencies. While they could perform those services without this contract, it would create another party for the government to manage and would create additional delays in having the Type C A-E review the original A-E's corrections, especially if there was disagreement between the firms. Because of these factors, full and open competition would not be in the best interest of the government.
