About this file

This is a Justification and Approval (J&A) document for use of other than full and open competition issued by the Department of the Navy, Naval Surface Warfare Center, Crane Division.

The Navy seeks to award an Indefinite Delivery Indefinite Quantity (IDIQ) contract on a sole source basis to Lockheed Martin (LM) Corporation for Contractor Support Services (CSS), Interim Sustainment Support (ISS), system upgrade support, Foreign Military Sales support, and associated supplies and services for the Target Sight Systems (TSS) series. The estimated total contract value is $66.5 million over FY25-30, with approximately 30% supplies and 70% services. The scope includes procurement of CSS, ISS, and engineering support for the TSS; depot-level repair; spares and repair parts; functional test equipment; maintenance and consumables; training; technical publications; manufacturing and productivity improvements; engineering change orders; technical services for system installation, integration and qualification; ground and flight test support; software/firmware analyses; and integrated logistics planning and support. The TSS provides day and night targeting capability for unnamed aircraft platforms and is mission-critical to the aircraft's primary weapons functionality through its mid-wave infrared imaging sensors and laser rangefinder designator. The platform cannot fulfill its primary mission without the TSS.

The justification for sole source award cites 10 U.S.C. 3204(a)(1), asserting LM is the only responsible source capable of providing required CSS and ISS services. LM is the original designer, developer, and manufacturer of the TSS and possesses exclusive access to the TSS Level III Technical Data Package (TDP). The Navy requested the Level III TDP from LM on multiple occasions (July 2012, April 2014, 2021, and 2025) to enable full and open competition, but LM refused to provide unlimited or Government Purpose Rights to the technical data. Without access to the Level III TDP, alternative vendors would require extensive reverse engineering and development of troubleshooting and repair procedures, which would significantly delay capability development, increase repair failure risk, lengthen spare procurement timelines, and divert aircraft resources. Market research conducted by NSWC Crane's Electro-Optics Technology Division, including a Request for Information posted on SAM.gov with a closing date of 26 June 2024, yielded minimal vendor interest and confirmed no other sources are capable of satisfying requirements given the required delivery and deployment schedule. The Contracting Officer has determined the anticipated cost to be fair and reasonable. Approval was digitally signed by Dr. Angela Lewis, NSWC Crane Technical Director and Senior Executive of the Science and Technology Reinvention Laboratory, on 26 June 2025.

Text version

Given the technical complexities of the TSS components, access to the TSS Level III TDP is necessary to meet the Government's requirements under this anticipated contract for CSS and ISS supplies/services. LM is the original designer, developer, and manufacturer of the TSS. Only LM possesses the requisite design details, in-depth knowledge, manufacturing process knowledge, and proprietary software codes to produce, modify, and repair the TSS. The performance of the required services and spares support requires extensive knowledge and familiarity with complex and specialized subsystems and components on which the work is to be performed and its relationship to other systems on the air platforms where it is employed. The TSS is the targeting system for all weapons on the aircraft and is the laser designating system for all laser guided munitions carried on the aircraft, or fired by other friendly units. Only LM has the knowledge and experience in the design and production of the equipment, and the personnel qualified to disassemble and reconfigure the TSS, diagnose problems, and accomplish the required support promptly and effectively.

In efforts to openly compete the TSS requirement, on 12 July 2012, 28 April 2014, NSWC Crane requested pricing from LM to acquire the TSS Level III TDP suitable for full and open competition of the TSS production effort as well as CSS and ISS. The TDP would have permitted competitive procurement of the CSS and ISS to be acquired under this effort. LM responded that it was unwilling to sell unlimited or GPR for the TSS to the Government.

Without rights to a Level III TDP, a competitively selected source for the tasking hereunder would need to develop the technical data and expertise to support sustainment of the TSS. A source other than LM would have to attain detailed understanding of the system hardware, software and interfaces in order to develop fault analysis processes, and repair and test procedures and equipment, whereas LM can be expected to immediately leverage knowledge, experience and tools acquired during the development and integration of the TSS as well as utilizing its full TDP.

Alternatively, without the Level III TDP, the Government would need to reverse engineer the TSS to develop these necessary drawings which would significantly delay the development of the capability to fully support fleet operations. Additionally, it would increase the risk of induced failures during repair, lengthen the time required to procure spares, and increase the requirement for aircraft resources dedicated to this effort.
