About this file

This document is a Justification for Other Than Full and Open Competition for Solicitation SPRBL1-22-R-0001. The U.S. Army's Communication-Electronics Command (CECOM) issued a Sources Sought Announcement to find potential sources for the Electron Painted Parts (EPP) spares needed to support this requirement. Jenoptik is identified as the sole-source for these NSNs, as they own the technical data. Another interested vendor, Alturdyne International, was unable to be evaluated due to lack of available technical data. The Government will include alternate product evaluation clauses in the solicitation in case other offerors submit proposals. The anticipated cost to the Government is expected to be fair and reasonable based on price analysis. The related federal contract opportunity, SPRBL124D0008, awarded 4 EPP spare parts NSNs to an unknown vendor on May 8, 2024.

Market Research/Efforts to Obtain Competition:

Describe the market research conducted and the results: The U.S. Army’s Communication-Electronics Command (CECOM) issued a Sources Sought Announcement (SSA) through the Government Point of Entry (GPE) SAM.gov to find potential sources capable of producing the EPP spares needed to support this requirement. The SSA was posted to the GPE from November 20, 2020 - December 4, 2020, with NSNs, part numbers, and CAGE codes to identify the required components. However, due to a delay caused by a change in requirements, the original SSA expired, and a new SSA was release , with a close date of February 22, 2022. Jenoptik had already confirmed their interest on the original SSA and reconfirmed it for this SSA. One other response was received by small business Alturdyne International (Alturdyne) (CAGE 52515) stating they are interested in becoming a source. According to the Army Engineer, Alturdyne is a manufacturer of similar parts. Since Jenoptik is the sole-source for these NSNs and own the technical data, and thus there is no TDP or specification available for Alturdyne to manufacture the parts to. The Government does not possess technical data that completely defines the form, fit, and function of the items being procured. Therefore, the Army Engineer cannot evaluate Alturdyne’s capability to provide the parts. However, if Alturdyne or another offeror would like to submit an alternate product, DLA Procurement Notes L04 Offers for Part Numbered Items (SEP 2016) and M06 Evaluation of Offers for Alternate Products for Part Numbered Items (SEP 2016) will be included in the solicitation.

The contract specialist conducted additional market research by querying I2Log and WebFLIS in October 2021 to get more information. Jenoptik, CAGE , is listed as the primary source of these NSNs. It has an assigned Acquisition Method Code (AMC) is "3" which means acquire directly from the actual manufacturer, whether or not the prime contractor is the actual manufacturer. It has an assigned Acquisition Method Suffix Code (AMSC) of “C”, meaning “This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing knowledge by the qualified source(s) require acquisition of the part
