About this file

This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for Solicitation SPRBL1-24-R-0002 issued by the Defense Logistics Agency, Land and Maritime.

The J&A supports a sole-source award to Collins Aerospace for a 5-year base period with a 5-year option period on an Indefinite-Delivery Indefinite-Quantity (IDIQ) contract for four Line Replaceable Units (LRUs) that support the AN/ARN-153 Advanced Digital Tactical Airborne Navigation (TACAN) system used on Army aircraft. Collins Aerospace is the original equipment manufacturer and the only known source that possesses the required technical data, expertise, and certifications to produce these items. Without the technical data package, it is not feasible for any other contractor to reverse engineer and replicate the form, fit, and functionality of these TACAN components. The estimated 10-year value for these four LRU NSNs is provided. The J&A includes details on previous sole-source awards for these NSNs to Rockwell Collins (now Collins Aerospace). Efforts to ensure competition for subcontracting opportunities are described. The Contracting Officer has determined the anticipated costs will be fair and reasonable through cost and price analysis techniques.

SOLICITATION SPRBL1-24-R-0002

[X] ORIGINAL

[ ] ADDENDUM (attach copy of original J&A for add-ons or revisions)

1. This acquisition is being procured by the Defense Logistics Agency, Land and Maritime, Land at Aberdeen (“DLA-DSCC-ZLAA” or “DLA”).

2. The action being approved is the acquisition of supplies on an other than full and open competition basis to Collins Aerospace. This Justification and Approval (J&A) supports a solicitation using other than full and open competition procedures for the award of one five-year base period and one five-year option period of Firm-Fixed-Price (FFP) line items on an Indefinite-Delivery Indefinite-Quantity (IDIQ) Long-Term- Contract (LTC) for supplies in support of the AN/ARN-153 Advanced Digital Tactical Airborne Navigation (TACAN) system.

3. The supplies required to meet the using activity’s needs are described as follows.

These parts support systems used in Army aircraft to aid in tactical navigation. The AN/ARN-153 Advanced Digital TACAN provides slant range distance, relative bearing, velocity, time-to-station, and audio identification to instruments on the aircraft. This system provides accurate altitude and distance functions to by means of radio frequencies. The four (4) items to be acquired for the AN/ARN-153 Line Replaceable Units (LRU) NSNs are listed below. The table below provides additional information on the supplies to be procured under this acquisition.

information relating to, but not limited to, design, software/firmware descriptions and source code, wire lists, schematic diagrams, interface control documentation, manufacturing processes, specifications, test equipment, acceptance/qualification testing, specialized production tooling, master patterns, parts lists and material sources to allow any capable manufacturer to fabricate and replicate the form, fit and functionality of the mechanical and electrical TACAN components.

As the OEM, Collins Aerospace is the only known source that possesses the expertise, certifications, and knowledge to produce the items. Only Collins Aerospace possesses the required technical data to produce the items, and assure with testing, that the produced items will function correctly. Since the Government does not possess the TDP for the TACAN configurations, it cannot be provided to others to produce the units. Without the required TDP, it would not be feasible to source the products from any other source other than the OEM, Collins Aerospace, as another contractor would be required to reverse engineer the TACAN units, which would result in a substantial duplication of cost that would not be recovered through competition and unacceptable delays in fulfilling the Government’s current requirements.

As stated above, the only known source of supply is Collins Aerospace, CAGE Code: 13499.

As listed in the table on Page 1, all the units have Acquisition Method Code (AMC) of 3 and the Acquisition Method Suffix Code (AMSC) of R.

The AMC of 3 means to “Acquire, for the second or subsequent time, directly from the actual manufacturer.” The AMSC of R means “[t]he Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights.”

7. Efforts to ensure that offers are solicited from as many sources as practicable are described below.

The acquisition will be synopsized in the System for Award Management website (www.SAM.gov), Contract Opportunities at least 15 days prior to issuance of the solicitation. The solicitation and the resultant contract will include subcontracting opportunities to increase the industrial base.

A small business subcontracting plan will be required per FAR 52.219-9 Small Business Subcontracting Plan (Sep 2023), and DFARS 252.219-7003 Small Business Subcontracting Plan (Dec 2019).

FAR 52.244-5 Competition in Subcontracting (Dec 1996), will be included and requires a contractor to select subcontractor and suppliers on a competitive basis to the maximum extent possible.

8. Determination that the anticipated cost to the Government will be fair and reasonable is listed below.

As the Contracting Officer, I hereby determine that the anticipated costs to the Government will be fair and reasonable by utilizing a combination of cost and price analysis techniques in accordance with FAR 15.404- 1(b)(2). For price analysis, these techniques include, but are not limited to, a comparison of proposed prices to historical prices paid for the same or similar items, and comparison of proposed prices with Independent
