FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items - Sole Source Justification and Approval
1. Contracting Activity: MICC Center-Fort Bragg
2. Description of Action: The Directorate of Emergency Services requests a firm-fixed price contract with Carolina Telephone and Telegraph Company OBA Century Link, 5454 West 110TH Street Shawnee Mission, KS, 66211-1204. The Government projects award for 1 November 2020 utilizing fiscal year 2021, funds type under Operations and Maintenance funds.
This action is a follow-on to contract W91247-17-P-0006. That contract was competed under authority FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. Actions to Increase Competition of the previous justification, stated: This requirement has been competed on an unrestricted basis three times during the past several years and each time, Century Link was the only company to respond with an offer. The local market will be monitored throughout the proposed period of performance. If the market develops into a competitive environment subsequent options will not be exercised and a competition will be conducted. Those actions were not accomplished due to Century Link being the only telecommunications company equipped to provide 911 selective routing services to Fort Bragg. Century Link has provided these services to Fort Bragg at least since 1 May 201 O through continual issuance of purchase orders. Century Link is the sole owner of the infrastructure that provides selective routing in the local area and does not allow resale of this telecommunication utility service.
An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d) (i) (B).
3. Description of Supplies/Services: The Fort Bragg Directorate of Emergency Services (DES) has a telecommunications utilities service requirement for Automatic Number Information (ANI), Automatic Location Information (ALI), and Selective Routing (SR) for all commercial landline and cellular 911 calls originating from Fort Bragg and outlying areas including but not limited to Simmons Army Airfield, Linden Oaks and Camp Mackall. The contractor shall route calls to the main 911 Center located in building 2-5935 on Fort Bragg and the alternate Dispatch Center located in Building 250 on Pope Army Airfield (PAAF).
The quantities of supplies required are 4 each wireless Combined ANI/ALI Selective Routing; 5 each Wireless Combined ANI/ ALI/ Selective Routing; 3 each ALI Data Circuit Channel Termination; and 5 each CAMA Voice Circuit Termination during each period of performance.

Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5: Sole Sourced, The purpose is the selective routing is to provide telecommunications utilities service requirement for Automatic Number Information (ANI), Automatic Location Information (ALI), and Selective Routing (SR) for all commercial landline and cellular 911 calls originating from Fort Bragg and outlying areas including but not limited to Simmons Army Airfield, Linden Oaks, and Camp Mackall.
5. Reason for Authority Cited: This action must be accomplished through a sole source solution as Century Link is the only telecommunications company equipped to provide 911 selective routing services to Fort Bragg. Century Link is the sole source provider for the landline telephone system on the Installation, and is the sole owner of the infrastructure that provides selective routing in the local area and does not allow resale of this telecommunication utility service. Century Link is the only vendor that can satisfy the required maintenance and support necessary to maintain the Installations 911 Center. There are no alternatives other than obtaining the support through Century Link, and if the service was not provided it would create mission failure for the 911 Center.
(a). The Army has contracted Centurylink to Maintain the 911 System on Fort Bragg, Pope Army Airfield, Simmons Army Airfield, Linden Oaks and Camp Mackall since 1 May 2010. Centurylink has the infrastructure and certified technicians to install, maintain, and provide the Emergency Dispatch System that is interlinked to the Public 911 network. The ALI Database server has become part of the Army's Emergency Dispatch System. Without Centurylink providing, installing, provisioning and maintaining the ALI Database Server, the loss of life and property will be at a grave risk during emergencies as critical 911 information for soldiers and family members will not be communicated to emergency responders.
Per the previous Market Research dated 20 September 2016 and the Approved J&A dated 26 October 2016 forW91247-17-P-0006, Selective Routing was performed under Fort Bragg's contract with Century Link for commercial telephone service in the beginning of the Selective Routing Service prior to 2009. However, in 2009, the contract was awarded to Time Warner Cable. After the contract awarded, it was discovered that Time Warner Cable did not possess the infrastructure to perform Selective Routing. Due to the foregoing, DES separated the selective routing requirement from the commercial telephone service contract. The selective routing contract W91247-1 0-P-0207 was sole-sourced to Century Link in accordance with
(JAW) FAR 6.302-1.
The Selective Services requirement was competed unrestricted three times from November 201 0 to November 2012 and each time, Century Link was the only company to submit a proposal. Based on the lack of competition with this requirement previously, this acquisition has been sole sourced during the last two contracts.
(b) Alternatives: There are no other alternatives to the current selective routing system required on Fort Bragg. Interoperability and commonality of integrated 911 Emergency Services systems within Fort Bragg with those supplied by Centurylink must be maintained. The 911 Emergency system integrity must be guaranteed and only trained Centurylink technicians and engineers are to be involved with the design and implementation of the in-place infrastructure system. Among the other possible alternatives, (a) suspending operations, (b) utilizing inhouse personnel or expertise, and/or (c) replacing rather than upgrading an existing system are unacceptable due to cost and the possibility of loss or life and property.
(c) Interoperability with other Public Switched Network systems and Statewide 911 Network systems must be maintained at all times. Centurylink certified technicians and engineers maintain the 911 system on Fort Bragg making interoperability between the Public Switched Telephone Network (PSTN) 911 network and the Army's network a critical consideration. Centurylink PSTN 911 network provide commonality of system and data sharing among federal, state, and local governmental agencies.
As the sole proprietor of the current selective routing system infrastructure on Fort Bragg, Centurylink is the sole sourced company to always upgrade this system.
Centurylink can provide a compatible solution for updating the current Voice I Data 911 system that is currently installed. Market research clearly shows that selecting vendors other than Centurylink will result in failure in integration of the current network. No other system can be used and if another vendor would enter the market, the initial cost to build the infrastructure would be a huge expense for the Government. Due to the competitive nature of keeping their respective systems isolated from another competitor, integration of another vendor's method with the current system may result in system failures.
The effect to the Fort Bragg community would be grave damage if this J&A is not approved to sole source Selective Routing through Centurylink. The harm would put lives and safety of the community in jeopardy. Response to emergencies would cease or be delayed when seconds/ minutes count during accidents, fires, natural events, and other unforeseen unplanned events. There would be a high probability of mission failure due to personnel and facilities unavailability.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201.
7. Actions to Increase Competition: The requiring Activity (RA) has previously conducted market research to locate other vendors. During the market research it was identified that the Installation's sole landline telephone system is Century Link and it would require the same system to provide selective routing to the Installations 911 Center. The local region will be continuously monitored to see if the marketplace opens up additional vendors. If the market develops into a competitive environment, subsequent options will not be exercised if it can be determined that in the best interest of Government a new contract is more practical thus resulting in a competitive contractual
