About this file
This document is a justification and approval for using other than full and open competition to award a purchase order. The purchase order is for repair parts for the high pressure and low pressure propulsion steam turbines and ship service turbine generator steam turbines onboard the USS FRANK CABLE (AS-40). The parts are required for an overhaul of the turbines. The estimated combined value of the purchase order will be funded using fiscal year 2022 Navy working capital funds. Original equipment manufacturer parts from Curtiss-Wright, MI-Tech, or PJ Schwalbenberg are required due to their proprietary technical data, knowledge, experience, and tooling. Posting of a sources sought and review of qualified alternatives on the MSC website did not yield any additional sources. The justification cites 10 U.S.C 3204(a)(1) for this limited competition. A fair and reasonable determination was made according to FAR 13.106-3(a).

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 3204 (a)(1) Only One Responsible Source or Limited Number of Responsible Sources and no other type of property or service will satisfy the needs of the agency.
5. Rationale Justifying Use of Cited Authority: There are currently two active AS Class Vessel’s in the
MSC Fleet; each vessel has a HP & LP Propulsion and SSTG Steam Turbines onboard. The Original Equipment Manufacturer (OEM) is Delaval Corporation (now Curtiss-Wright) owns the proprietary drawings, technical manuals and design information for the HP & LP Propulsion and SSTG Steam Turbines and Reduction Gears onboard the AS Class Vessels. The information is not available to limited sources outside of Curtiss-Wright and this information is required to provide Technical Support and Replacement Parts for the HP & LP Propulsion and SSTG Steam Turbines and Reduction Gears onboard. MSC N7 Engineering Director has officially recognized MI-Tech Inc. and PJ Schwalbenberg as sources also having access to the required technical documentation, knowledge, experience, and tooling to accomplish the requirements.
Safety Management System (SMS) Procedure 10.6-002-ALL list the HP and LP Propulsion and SSTG Steam Turbines as Critical Equipment. COMSCINST4490.1B requires all parts on this equipment be supplied by the OEM or an MSC N7 Engineering Director recognized OEM equivalent. The three companies listed in Paragraph 3 are either the OEM (Curtiss-Wright) or have been evaluated and received a letter (MI-Tech & PJ Schwalbenberg) from the MSC N7 Engineering Director stating that they possess the required special knowledge, experience, special tooling and access to proprietary technical documentation necessary to supply the required parts.
Failure of the HP or LP Propulsion Steam Turbine will result in the loss of the ability for the vessel to get underway. The loss of the HP or LP Turbine puts the vessel in a C-4 CASREP status, thus tying the vessel to the pier until repairs are made. Failure of one SSTG will result in the loss of Electrical Power Generation Capacity or Redundancy. The loss of two SSTG’s puts the vessel in a C-3 CASREP status, thus reducing its ability to perform its primary mission. Proper refurbishment and maintenance of the HP & LP Propulsion and SSTG Steam Turbines is critical to the safe operation of the AS Class Vessels.
MSC does not own the proprietary technical data rights to this equipment onboard the AS Class Vessels.
MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The sources sought for the proposed purchase order was posted on the SAM.gov website on April 20, 2022, and closed April 27, 2022, with two responses from MI-Tech and Curtiss-Wright, both indicating their respective companies are capable of providing the parts for this requirement. MSC perpetually seeks submissions from non-OEM contractors for consideration of qualification of their parts and/or services as an acceptable alternative to the OEM at https://www.msc.usff navy.mil/Business-Opportunities/Contracts/Qualification-for-Items-Critical-to-Shipboard-Safety-on-MSC-Vessels/. The Government intends to post a combined synopsis and solicitation notice along with this justification at the Government Point of Entry with the intent of awarding a firm-fixed-price purchase order to the lowest price technically acceptable quoter.
7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable IAW FAR 13.106-3(a).
8. Actions to Removed Barriers to Future Competition: For reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts or purchase orders for the types of supplies covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
