About this file
This is a Justification and Approval (J&A) document for other than full and open competition, issued by the United States Air Force (USAF) AFLCMC/EBHKB contracting office for the procurement of explosive rotary actuators for aircraft egress systems.
The USAF will award a sole-source contract to Nammo Defense Systems Inc. (NDS), CAGE 12116, located in Mesa, Arizona, to produce three types of explosive rotary actuators for use in the T-37, F-5, and T-38 aircraft egress systems. The three components are: Actuator, Explosive (Rotary) for T-37 (NSN 1377008916319ES, P/N 1000-45); Actuator, Explosive (Rotary) for F-5 (NSN 1377004079649, P/N 1000-52); and Actuator, Explosive (Rotary) for T-38 (NSN 1377010497586, P/N 1000-54). The contract will be awarded under Firm-Fixed Pricing with an estimated award date of 16 July 2026 and a 24-month delivery period. The procurement is funded through 4F/FMS (Foreign Military Sales) funds and is classified as an Individual J&A for a dollar value exceeding $750K but under $15M. No data rights acquisition is included in the contract line items as NDS is unwilling to sell proprietary technical data. The justification for sole-source procurement cites NDS as the exclusive owner of the unique technical data, proprietary explosive filler combinations, firing mechanisms, and precise interface requirements necessary for production. A Sources Sought Synopsis was posted to SAM.gov from 8 April 2025 to 24 April 2025, receiving no vendor responses. The document was approved by the Competition Advocate on 17 December 2025.

I. Agency and Contracting Activity.
United States Air Force (USAF) AFLCMC/EBHKB 6072 Fir Avenue, Building 1233 Hill AFB, UT 84056-5805 Contracting Officer: Darin Barnes
II.Nature and/or description of the action being approved.
A. Upon approval to use other than full and open competitive procedures, the United States Air Force (USAF) will award a contract to produce the components listed in Section III for use in the egress systems of FMS T-38, T-37, and F-5 Aircraft. The contract will be awarded to Nammo Defense Systems Inc. (NDS), formerly known as Nammo Talley Inc., CAGE 12116.
Nammo Defense Systems Inc 4051 Higley Road Mesa, Arizona, 85215 CAGE Code: 12116
B. Contract Type and Structure: One new supply contract will be issued to produce rotary actuators utilizing a Firm-Fixed Pricing arrangement. The estimated award date is 16 July 2026, with delivery being 24 months after award date. No additional contracts will be awarded under the authority of this J&A.
C. Estimated value is:
D. Type J&A: Individual
E. Last contract for these items: FA821318D0005
III. Description of supplies/services required to meet agency needs.
A. Under the authority of this Limited Sources Individual J&A, Nammo Defense Systems Inc (NDS) will provide the explosive rotary actuators for the T-37, F-5, and T-38. These requirements were developed by FMS countries based on their need. This acquisition is a supply buy.
NSN P/N NAME Est. Qty 1377008916319ES 1000-45 Actuator, Explosive (Rotary)(T-37) 1377004079649 1000-52 Actuator, Explosive (Rotary)(F-5) 1377010497586 1000-54 Actuator, Explosive (Rotary)(T-38)
TOTAL:
B. Total Estimated Cost: This action is using 4F / FMS funds.
C. CLINs will not include data right acquisition as NDS is unwilling to sell their proprietary technical data.
IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.
A. These highly specialized items contain a proprietary and unique combination of explosive fillers, firing mechanisms, and have precise interface requirements within the aircraft egress system. NDS is the only entity possessing the unique qualifications necessary to undertake production of these specialized parts. Each component listed in Section III plays a critical role in ensuring the safety and survival of the aircrew in case of an emergency. Each component is intricately designed and engineered to
August 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 3 of 5August 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 3 of 5 function reliably and effectively in extreme conditions, such as high-speed ejections, rapid decompression, or other emergency scenarios. Their specialization lies in precision engineering, which must adhere to stringent military specifications and certifications. NDS was the developer, and is the exclusive owner of the technical data required for manufacturing rotary actuators.
B. NDS has provided limited top level data rights to the United States Government (USG). These top-level drawings are only sufficient to load basic information about the products into our systems. (e.g., part number, shelf life, and dimensions).
C. The CAD/PAD Joint Program Office (CAD/PAD JPO) has determined that award to any other source would result in unacceptable cost to the government that is not expected to be recovered through competition and unacceptable delays in fulfilling FMS requirements. This cost is based on recent industry averages and covers the creation of technical data rights, development of applicable test fixtures and associated requirements. Current assets, and technical data top level drawings, production, and technical guidance are proprietary to the vendor and would require extensive research and development costs to properly reverse engineer requirements to satisfy program needs.
D. Accordingly, NDS, is the only firm capable of providing the supplies and services described in Section III above without the Government experiencing unacceptable costs that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. A four to six year time frame is assumed to develop, test, and certify required production and test equipment to validate requested items, NDS provided top level drawings for cataloging purposes only; cataloging is used for assigning a National Stock Number (NSN).
V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under FAR 5.202 applies.
A. Sources Sought Synopsis: A Sources Sought Synopsis, FA821325R3016, was posted to SAM.gov 8 Apr 2025 and closed 24 Apr 2025 requesting information to identify potential sources possessing the engineering and manufacturing knowledge for items identified in Section III used on T-37, T-38A, and F-5. No vendors responded to the Sources Sought Synopsis.
B. This requirement will be synopsized in SAM.gov as a Notice of Contract Action IAW FAR 5.201. If other interested sources express interest as a result of this synopsis or other action, they will be listed in the official contract file.
C. Other Actions: None
D. Qualifying Country Sources: None
VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
In order to prevent inflated pricing, the contracting officer will explore the contractor cost elements to include direct and indirect costs, material, and profit and any other costs and run a weighted guidelines against these costs in order to determine them fair and reasonable.
VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
A. As described in Section V above, a sources sought synopsis of the proposed contract action advising industry of the pending acquisition and soliciting inquiries from interested parties was posted. No interested parties responded to the Sources Sought Synopsis.
B. Market research was conducted IAW FAR Part 10 which included a review of recent market research for similar items, a query of government qualified vendor forms, utilization of source lists for similar items, and a review of commercial catalogs and other product literature.

C. The items listed in Section III are not available commercially nor are any modified commercial items available that will meet the government's requirement. Additionally, this requirement is a non-developmental item (NDI).
D. The current Trainer Integrated Product Team determined that NDS is the only vendor that currently has the required technical data packages and claims rights to the data needed to produce the items identified in Section III.
VIII. Any other facts supporting the use of Other Than Full and Open Competition.
N/A
IX. List of any sources that expressed, in writing, an interest in the acquisition.
See Section V, Paragraph A above.
X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.
A. The CAD/PAD office is focused on continuously expanding its vendor base and seeking new sources whenever possible.
Engaging in annual technical interchange meetings with customers, vendors, and industry partners facilitates the exchanging of insights and fresh ideas within the entire egress community. These conferences serve as platforms for reviewing industry advancements and exploring potential substitute products that can fulfill the requirement of form, fit, and function.
B. CAD/PAD maintains regular communication with vendors of similar products to assess their potential to become qualified sources for the items listed in Section III and others. By leveraging existing relationships and exploring new partnerships, the office continually tries to broaden its supplier network.
C. At least on an annual basis, the CAD/PAD team requests from their sole source vendors to purchase detailed data rights/ packages in order to pursue depot sustainment or find other sources. NDS was contacted on 04 Nov 2024, and responded that they were not willing to sell/relinquish data rights.
D. Additionally, a Sources Sought Synopsis is always posted on SAM.gov prior to the initiation of sole source contracting efforts, providing an opportunity for other potentially capable and qualified vendors to inquire about becoming a second source.
This proactive approach ensures that all eligible vendors are given fair consideration and encourages competition.
E. There have been no specific actions, outside the four items listed in A-D of this section, to increase competition. CAD/PAD does not have the budget to fund second sourcing on behalf of FMS customers.
