About this file
This is a Class Justification and Approval document for the use of other than full and open competition, issued by the Naval Sea Systems Command (NAVSEA) under the Department of the Navy.
NAVSEA justifies sole-source awards of orders under two Basic Ordering Agreements (BOAs): N00024-21-G-4305 and N00024-22-G-4304. The procurement covers shipbuilder-coded unique parts and specialized submarine materials that cannot be readily obtained through standard Navy supply channels such as NAVSUP or the Defense Logistics Agency (DLA). The class justification covers additional submarine material requirements identified following the original BOAs' award. Authority to act under this class justification expires on October 30, 2026. The statutory authority permitting this non-competitive procurement is 10 U.S.C. 3204(a)(1), which allows sole-source awards when only one responsible source can satisfy agency requirements. NAVSEA documented that the identified contractor sources possess unique capabilities to deliver these specialized materials without unacceptable delays to Navy operations, and that award to other companies or delaying procurement would result in operational delays. The Contracting Officer has determined the anticipated costs to be fair and reasonable. To address competition concerns, NAVSEA posted synopses and sources sought notices on the System for Award Management (SAM) website on October 13, 2020, April 5, 2021, January 12, 2023, and January 20, 2023. NAVSEA plans to issue a separate sources sought notice to explore broader approaches to future VIRGINIA-class material requirements, including strategies involving additional vendors and original equipment manufacturers. The document is signed by the Acting Assistant Secretary of the Navy for Research, Development and Acquisition, approving the sole-source solicitation.

NAVSEA announced the ceiling increase described in this class justification revision via sources sought and synopsis notices posted to the SAM website on 12 January 2023. NAVSEA subsequently posted an amended sources sought notice on 20 January 2023.
Notwithstanding the above, NAVSEA intends to issue a separate sources sought notice at a later date to explore a broader approach to satisfying VIRGINIA-class material requirements.
In particular, NAVSEA will investigate alternative strategies involving additional vendors and breaking out logical quantities or categories of material requirements to continue development of the necessary material inventories using other suppliers where available. This approach would also include OEMs for parts currently planned for procurement under the BOAs covered by this class justification revision.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this justification will be fair and reasonable.
8. Actions to Remove Barriers to Competition.
As discussed in paragraph (6) above, the Navy will conduct market research to explore a broader approach to satisfying future VIRGINIA-class material requirements, which includes identifying opportunities for future competition for these requirements involving additional vendors.
As this action constitutes a follow-on contract for supplies and services previously awarded on a non-competitive basis, per DFARS PGI 206.304(a)(i), the prior justification was provided to the approval authority for review. Approval of this justification signifies that the approval authority has made the determination required by DFARS PGI 206.304(a)(ii).
