About this file
This is a Justification and Approval (J&A) document for a sole source contract award issued by the Naval Air Warfare Center Weapons Division (NAWCWD) at China Lake, California.
The procurement authorizes award on a sole source basis to Daqscribe Solutions LLC for configuration, testing, documentation, software support, and delivery of a complete 3U VPX D2D (Direct to Digital) Radio Frequency and Ethernet Packet Capture and Record System. The system comprises two Air Transport Rack Ready Recorder Systems with Analog to Digital System Card and Equipment, and five 3.8-Terra Byte drives, totaling $0.9M with a 180-day lead time after contract receipt. The procurement is justified under 10 U.S.C. 3204(a)(1) based on the determination that only one responsible source can satisfy agency requirements. Daqscribe Solutions is identified as the sole capable vendor because the recorder's proprietary data format and interfaces are dictated by Interface Control Documents (ICDs) from the prime contractor and have been adopted by ONR FNC programs. All existing systems and software were designed exclusively around these specifications, making any alternative recorder functionally incompatible with the established program architecture. The justification cites prohibitive re-development costs (approximately $1.2M representing four man-years of engineering effort), irrecoverable investment in the ecosystem, and unacceptable schedule delays that would result from switching vendors. A Sources Sought Notice was posted to SAM.gov on March 17, 2026, yielding three responses; however, only Daqscribe Solutions was determined technically acceptable. The Contracting Officer has determined the anticipated cost to be fair and reasonable, and no plans exist to compete future contracts for these supplies unless another capable source emerges.

4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Daqscribe Solutions is the only vendor that can provide the specific 3U VPX Direct to Digital Radar Frequency (D2D RF) Ethernet data recorder that can meet the program's minimum needs as it is the required direct replacement for the established data recording and analysis infrastructure. The recorder's data format and interfaces are dictated by the Interface Control Documents (ICDs) provided by the prime contractor for the program of records. These ICDs were also adopted by ONR FNC programs. All existing systems and software were designed exclusively around these specifications. Therefore, any other recorder would be functionally incompatible and unable to meet the non-negotiable requirement of seamless integration with the established program architecture.
In accordance with FAR 6.302-1(a)(2)(ii)(B), these D2D RF Ethernet Packet Capture and Record systems are deemed only available from Daqscribe Solutions, as award to any other source would result in unacceptable delays in fulfilling the Government’s requirement. Delaying the procurement to find another source would significantly impact on the US Navy operating capabilities and increase the Initial Operating Capability (IOC) transition of new capability to program of record and ONR FNCs. No other manufacturer can provide a viable alternative because of the significant and irrecoverable investment made in the ecosystem surrounding this specific D2D RF Ethernet data recorder.
Proprietary Integration: The prime contractor has standardized this recorder for all program operations, making it the de facto standard. The supporting government agency has subsequently adopted this same product for all its development, test, and sustainment activities to maintain interoperability.
Prohibitive Re-Development Costs: A minimum of four man-years of engineering effort has been invested in developing custom analysis tools and software integration specifically for this recorder's proprietary data format. Costing approximately $1.2M to projects. No funding exists to replicate this extensive work.
Schedule Impact: Switching to a new recorder would require a complete top-to-bottom re-engineering and validation effort, including reverse-engineering the data format, rebuilding analysis tools, and re-validating the entire data chain. This would introduce unacceptable schedule delays, jeopardize milestones and put the risk reduction efforts for future work that is currently scheduled for the program at severe risk.
Any other product, regardless of its individual capabilities, would fail to integrate with this established and validated ecosystem, making this a unique, one-of-a-kind requirement.
J&A Number 26-0360
Therefore, award of a contract to any other source would result in substantial duplication of costs in man hours and rework of the recorder that are not expected to be recovered through competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In accordance with FAR requirements, a Sources Sought Notice for Ethernet Recorders was posted to Contract Opportunities on SAM.gov on March 17, 2026. Three responses containing company capability statements were received from:
Daqscribe Solutions, Inc.
The Program Office Technical Point of Contact (TPOC) evaluated all three capability statements against the government's technical requirements. The evaluations determined that
Daqscribe Solutions, Inc. was determined to be the only capable and technically acceptable source. In accordance with the technical rationale detailed in Paragraph 5, no additional market research was conducted as it is not practicable for any company other than Daqscribe Solutions, Inc. to provide the required supplies and services.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAWCWD China Lake, CA has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NAWCWD China Lake, CA will assess whether competition for future requirements is feasible.
