4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 3204(a)(1), Authorized or required by statute, as implemented by FAR 6.302-1(c) brand name commercial product.

5. Rationale Justifying Use of Cited Statutory Authority

The current kit configuration has been identified through an analysis of alternative and subsequent down select with the end-user operators. Deploying and packaging another cost advantageous to the Government. Award of any other brand name would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and would cause unacceptable delays in fulfilling the end-requirements.

Procuring these items individually would be inefficient. Shipping one kit is more efficient than shipping 720 separate items. The Government does not have the resources to kit these items. The cost for the Government to kit the 720 items would not be offset by individual competitive actions.

Any deviation from this request will result in unnecessary and potentially costly deviation in inventory configuration management and logistics in maintaining a miss-matched inventory that may result in mission failure, injury, or casualty from incompatible equipment. It is a requirement that all personnel have a uniform loadout in order to complete any mission required.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

NSWC IHD performed market research and identified multiple GSA Supply Schedule holders who could provide one of the items in the kit but not all of them. In accordance with Defense Federal Acquisition Regulation Supplement 206.302-1(d), a sources sought notice was released on SAM.gov on 03 September 2024 and two small businesses were identified that can provide all items in the kit, therefore this requirement will be released with a preference for small business.

As required by FAR 5.203, the proposed action was synopsized on SAM.gov website on 08 October 2024. Five companies responded and more than one small business was deemed capable.

7. Determination of Fair and Reasonable Cost

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, NSWC IHD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWC IHD will assess whether competition for future requirements is feasible.
