1. Contracting Activity: MICC WEST POINT

2. Description of Action: This approval is for a three-month firm fixed price bridge contract using O&MA FY 23 funds.

3. Description of Supplies/Services: Operation and maintenance of the West Point Cemetery for estimated period of 1 November 2022 – 31 January 2023.

4. Authority Cited: FAR 6.302-1(a)

5. Reason for Authority Cited: Solicitation W911SD22R0140 is under the source selection evaluation process. The five-year Cemetery contract W911SD19P0106 was already extended 6 months and cannot be further extended. The first bridge contract will expire on 31 October 2022. This new bridge will cover required services while the review is completed. The new building that the winning offeror was to occupy is not ready for possession. The current contractor has been working out of temporary

locations while the cemetery expansion project has been in progress. To have someone other than the current contractor perform services during this bridge period would be a large financial cost to the Government. There is no guarantee that another contractor would be prepared to start services on 1 November 2022 at a fair and reasonable cost with five days expected for award notice and with no location on West Point for staging.

6. Efforts to Obtain Competition: As required, a sources sought was posted on 18 October 2022.

7. Actions to Increase Competition: No actions were completed as this is a bridge contract pending the award from W911SD22R0140.

8. Market Research: Market Research was not completed as the research from W911SD22R0140 is still current.

9. Interested Sources: The current contractor and one other offeror responded. While a fair and reasonable cost is expected from the current contractor, the other offeror did not state that he understood it was a three-month contract only. Even with the firm understanding that this was a three-month bridge contract, the Government does not expect a fair and reasonable cost from a new contractor who would have to set up a location off West Point, hire employees, purchase and bring equipment and supplies to said location in less than two business days.

10. Other Facts:

The KO determination is that no entity other than the contractor presently performing on-site incumbent may meet the required continued performance requirements by 1 Nov 22. It is determined that even additional short periods of no performance are not acceptable and must be provided as there are ongoing timely needed services to be performed with time sensitive funerals, etc.

Ninety days is the minimum estimated period needed to allow for competition.

11. Technical and Requirements Certification: I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.

12. Contracting Officer Certification and Approval:

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based price analysis techniques listed in FAR 13.106-3.

Certified cost or pricing data is not required per FAR 15.403-1(b)(3).
