JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department
2. Description of the Action Being Approved
Award of a firm fixed priced contract on a sole source basis for cyber security licenses to be used by the Naval Surface Warfare Center, Dahlgren Division
(NSWCDD),
manufactured by Raytheon Cyber Solutions, Inc. (RCSI).
3. Description of Supplies/Services
The proposed requirement is for cyber security licenses manufactured by Raytheon Cyber Solutions, Inc. (RCSI). Cyber security software licenses are needed to protect our platforms, systems, networks, programs and data from cyber attacks. The licenses are required by September 1, 2022 in order to meet mission requirements. The Government's minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is . Fiscal Year 2016-2018 Shipbuilding and Conversion, Navy (SCN) funds to purchase this material will be used for this purchase.
4. Statutory Authority Permitting Other Than Full and Open Competition

5. Rationale Justifying Use of Cited Statutory Authority
RCSI provides a unique, critical software tool that meets the Government’s cyber requirements for radar systems and is in use across multiple platforms.
Flavor 1 and Flavor 2 licenses are compatible in all aspects (form, fit and function) with the radar systems presently installed. Proprietary rights limit competition. These software licenses are needed to test and troubleshoot deploy and development baselines for an upcoming deployment. The Government has invested millions of dollars in hardware and software across multiple platforms and decades of labor to identify, configure the infrastructures, install hardware and software across all the platforms and train personnel. Any major switch to our platforms will require extensive review and testing to validate the conversion and avoid fidelity issues. Failure to award this order will put the government’s platforms at risk of cyber warfare attacks and would present unacceptable schedule risks to Program Executive Office programs. Full and open competition would not provide the Government opportunity to realize any invested costs.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research and discussions with RCSI, the Original Equipment Manufacturer (OEM), confirm that the OEM’s Navy Representative can only provide all licenses. The NSWCDD has no plans at this time to compete future contracts for the types of supplies/services covered by this document due to the proprietary nature of this procurement. If a future requirement should arise, reappraisal will take place to determine whether competition is feasible. If another potential source emerges, NSWCDD will assess whether competition for future requirements is feasible.
No additional market research was conducted, because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than RCSI to provide the required licenses and renewals.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the equipment covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, Dahlgren Contract Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, Dahlgren Contract Department will assess whether competition for future requirements is feasible.
