About this file
This justification document seeks approval for a sole source procurement of direct replacement timing gear assembly parts from Fairbanks Morse Defense for the USS Portland (LPD-27). The Southwest Regional Maintenance Center requires the parts for repairs and maintenance to be conducted on the USS Portland starting in June 2022, with an estimated total value of $XXX and required delivery date of XXXXX. As the original equipment manufacturer, Fairbanks Morse Defense is the only source that can provide the proprietary parts which must be compatible in form, fit and function with the existing equipment. A sources sought notice resulted in no other offers. The contracting officer will determine price fairness and reasonableness by reviewing commercial price lists and sales history.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETION
Recommend procuring as a sole source requirement, in accordance with (IAW) FAR 6.302-1(c)(1)- Only one responsible source and no other supplies or services will satisfy agency requirements.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY
The original equipment manufacturer (OEM) is Fairbanks. Fairbanks supplied the parts and components to the original shipbuilder and maintains all the proprietary rights, patents, copyrights to all materials, drawings, equipment associated with these materials and is the only source with the capability to provide required parts / components. The specific replacement parts must be compatible in all aspects (form, fit, and function) with the existing equipment presently installed; therefore, the specific MPDE related parts must be procured directly from the OEM, Fairbanks. As the sole provider of these specific parts, they have the engineering in place to manufacture the MPDE equipment. To attempt to procure these products from any other source would result in substantial duplication of costs to the Government that could not be recovered through competition because the Government would be required to purchase an entirely new MPDE system.
