FAR 13.106-1 (b) states that, “For purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). The following documentation constitutes the rationale for this decision.

DOCUMENTATION:

(1) Requiring Activity:

Defense Security Service Industrial Security Field Operation Office 27130 Telegraph Road Quantico, VA 22134

Contracting Activity

Defense Security Service Office of Acquisitions 27130 Telegraph Road Quantico, VA 22134

(2) Supplies or services being procured:

IO supports DSS’ mission to protect classified information and materials in the hands of cleared industry by ensuring compliance with the National Industrial Security Program Operating Manual (NISPOM) and Executive Order 12829. Additionally, IO works in partnership with facility security officers and Industry representatives to ensure the protection of classified information released under contractual obligations or research and development efforts. In order to continue to perform this mission in an evolving and increasingly complex environment, IO must continuously review, analyze and update processes, procedures, organizational structure and methods.

In support of National Security DSS is in the midst of the most significant operational shift in 30 plus years. The need for change is clear. The United States (U.S.) is facing the most significant foreign intelligence threat it has ever encountered. Adversaries are successfully attacking cleared industry at an unprecedented rate, stealing our national security information and technology, using multiple and varying avenues of attack, prioritizing targeted information, and shifting priorities based upon their needs. As a result, they are using compromised national security information and stolen technology to upgrade their military capabilities and compete against our economy.

The contract extension is for a one-year period of performance. The estimated cost for the one-year extension is 175,000.00.

(3) Reason that this is a sole source procurement (i.e., proposed contractor's unique qualifications, etc.):

Originally, this contract had a period of performance set to expire on September 28, 2018, due to the mission completion of National Industrial Security Program (NISP) Authorization Office (NAO). Due to the continued growth to the DSS mission and DSS in Transition (DiT), it has been determined that an additional year of support is required to fulfill the mission needs of IO. Quality Technology, Inc. has provided NAO support to IO since 2016, Senior Business Analyst Support Services

transitioning this support to another contractor at this time would be detrimental to the mission and would cost the Government additional money, based on the time and efforts it would take to be able to train new contractor support to understand the mission and contract requirements, also taking away from the productivity of the current government employees.

Without this continued NAO support, authorization timelines will continue to increase, the benefits of Risk

Management Framework (RMF) will not be realized. Without continued support, the uncertainty of the RMF workload, Enterprise Mission Assurance Support Service (eMASS) deployment, and existing systems performance will negatively impact DSS and the end result is increased risks to national security.

The continued support will also enable IO to continue two ongoing operations: the Quality Assurance Program (QAP) for NAO and the transition to the RiskManagement Framework. To provide better response on new initiatives to DSS leadership, the IO Regions and Field Offices and our industry partners, it is essential to have a dedicated IO Business Analyst focused on process improvement and the strategic activities required to ensure these programs, projects and portfolios are effectively implemented at DSS.

This contractor support is critical to NAO's ability to adapt to DiT and other DoD guidance in support of cyber security. Some of the projects contractor support will be focused on are a result of changes to the NISP, which means that cleared facilities will have more risk based compliance issues to contend with in future.

DSS vulnerability assessments will broaden their scope to include insider threat, asset risk assessment programs and new information system security mandates. Keeping up with changing requirements and knowing where potential problems lie is critical to avoid security compliance issues and safeguard classified information.

Without this support, the current DiT projects that are being completed within IO will be discontinued without the provided support and resources that are needed to continue the critical processes and projects, which would result in undue harm such as cyber effectiveness and risk based management of cleared facilities to the missions that DSS supports.

(4) Market survey (indicate if any other firms were contacted or expressed interest)

Market research was conducted for the purpose of seeking as many potential sources as possible. Although Quality Technology, Inc. is the sole provider of these services to IO, there are multiple distributors with the required Senior Business Analyst support services available on the open market, through GSA and under the current competitive indefinite delivery, indefinite quantity (IDIQ) contract within DSS. If this requirement is determined to extend beyond this one-year extension, a recompete requirement will be competed amongst the DSS IDIQ contract holders.

(5) Technical requirements personnel certification

I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available.

(6) Price Reasonableness Determination:

In determining a fair and reasonable price, the Contracting Officer will evaluate a more detailed breakdown from a formal Independent Government Cost Estimate (IGCE) with historical information from the original contract award proposal. The detailed information will provide the level of effort of individual service items identified above and potential labor categories, as well as estimated labor rates. The estimated labor will be compared to established pricing on other Government contracts, such as the General Services Administration’s (GSA) Federal Supply Schedule (FSS) for the same labor categories and/or similar labor categories. Additionally, price comparisons will also be accomplished from as many other sources as possible, including commercially as well as any Government- Wide Acquisition Contracts (GWAC).

Leveraging DSS’ current use of the Quality Technology, Inc. services, along with a historical price comparison, the Contracting Officer is confident in obtaining the best value for DSS.

(7) Contracting Officer’s certification

I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my
