JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 0221.

2. Description of the Action Being Approved

This Justification and Approval (J&A) authorizes the award of a Firm-Fixed-Price, Contract on a sole source basis for the procurement of the installation and repair of control access equipment, including card readers, in support of Corona Division operational security and access control system to Johnson Controls, 5757 N. Green Bay Ave, P.O. Box 591, Milwaukee, WI 53201. This J&A shall be effective from the date of approval to the end of the contract term.

3. Description of Supplies/Services

Corona Division has a requirement to procure and install access controls, , and project management support, as well as technical expertise necessary to perform installation according to industry standards.

This J&A has a total estimated value (including options) of $668,730 for the quantities identified above. This requirement will be funded with Other Procurement, Navy (OPN) for Fiscal Year (FY) 2020 with possible options that extend the period of performance until FY 2023.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.

5. Rationale Justifying Use of Cited Statutory Authority

The Department of Defense (DoD) has deployed the Enterprise Mission Assurance Support Service (eMASS) across the entire DoD enterprise as part of the DoD’s overall security, both cyber and physical, initiative in accordance with DoD Instruction 8500.01.

The Defense Support of Civil Authorities (DSCA) provides guidance for the National Industrial Security Program (NISP) and eMASS. This guidance/mandate requires all units under the DoD to receive accreditation for their cyber and physical security programs. Corona Division is in the accreditation process utilizing the current command access system installed by Tyco under contract N6426717F0004. The rationale below are based on regulatory compliance, additional unnecessary costs, potential cyber risks that would not be identified until integrating/replacing components, and compatibility issues.

This requirement includes the upgrade and expansion of the currently approved Johnson Controls system infrastructure, which identifies Corona Division’s eMASS Authority to operate accreditation. Changing/altering the entire system to another type of access control would result in rejection of the existing accreditation and would require the new system to go through the entire eMASS accreditation process to bring the command into compliance with DoD Instruction 8500.01. These additional costs, which include labor and replacing the infrastructure are unnecessary and counterproductive, unavoidable, and would cost approximately $708,000 in material, labor hours and hardware.

Additional adverse risks with replacing the infrastructure includes voiding current supporting infrastructure agreements and warranties, which increases maintenance costs. These factors include replacing: covering doors, card readers, and security systems. The costs would be in excess of $93,000, which is the average costs of similar industry items and maintenance agreements.

Should a new vendor be selected to install a new system, there would be compatibility issues that would create unnecessary adverse risks and costs.

Unless the Government purchases from Johnson Controls, multiple adverse factors include Accreditation/regulatory issues, cyber security risks, and delays. Other elements include additional costs, which include replacing the supporting infrastructure.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A Sources Sought Notice (SSN) was posted on the beta.sam.gov website on April 6, 2020 to express the Government’s intent to sole source this requirement. One (1) business responded and submitted a capability statement. Stanley Security’s capability statement was sent to the technical code for evaluation and was found unacceptable.

Stanley Security did not show the capability to work with Johnson Controls hardware or software. Further, Stanley Security did not show the ability to interface with any access controls provided by other companies. Additionally, Stanley Security presented a solution dependent on the use of cloud based monitoring, which would invalidate the current eMASS accreditation and would leave the base non-compliant with DoD security protocols. The capability statement also detailed remote trouble shooting entailing the creation of outside access to the base security network which would also leave the base non-compliant with DoD mandated eMASS security protocols.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Corona Division will utilize price analysis, commercial price lists, historical costs, and cost estimating relationships from previous procurements to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Competition

Corona Division will continue to perform market research to identify capable sources for future requirements related to this effort and if another potential source emerges, Corona Division will assess whether full and open competition is feasible.
