FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.

5. Reasons for Authority Cited:

The Chemical Test Division (CTD) at Dugway Proving Ground (DPG), Utah, requires Life Cycle Replacement (LCR) of aging Gasmet DX-4000 Fourier-Transform Infrared (FTIR) analyzers, many of which are nearing 20 years of age. The CTD routinely utilizes FTIR analyzers during testing to monitor vapor concentrations of toxic industrial chemicals (TICs), chemical agent and chemical agent simulants, nerve agents, and in Compact Vapor Chemical Agent Detector (CVCAD) testing. It is imperative to CTD and DPG that analyzers be able to accurately and consistently record results as a mission essential requirement.

Cerex products are wholly self-contained, inclusive units consisting of analyzer, computer, and internal vacuum pump that does not require an external nitrogen purge.

Current Gasmet FTIR spectrometers require an external computer, five connector cables, and an external pump for operation, which significantly increases test setup time and complexity. Additionally, the Cerex units are fully portable and ruggedized for use in field conditions (not just laboratory testing) expanding testing capability and accessibility.

The integrated system is patented by Cerex and utilizes superior proprietary technology, intellectual property, and engineering of each unit. The spectrometers will vastly improve the current capabilities of the CTD field referee group, increasing accuracy and viability of testing results and contributing to the success of the overall mission. The consolidated design not only saves operational costs and complexity upfront, but ongoing cost savings will be substantial as well. As time and testing continues, the benefit to the Government will increase.

Impact to Mission if highest quality product not procured:

The patented capability of the Cerex spectrometers provide distinctive technology, portability, and high capability of chemical monitoring results unique to the commercial market. It is critical that the highest quality products be used for CTD testing in order to meet mission requirements. Cerex Monitoring Solutions, LLC, is the only reasonably available source of the above products.

Cost Impact: As repair of existing systems is no longer viable due to age and use, LCR with new units is vital.

Time/labor Impact: Old units have become inoperable and are due for LCR. In addition, using a fully integrated, self-contained unit will save manpower hours in setup and operational costs, yielding long-term savings.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at FAR

7. Market Research:

Extensive internet searches of portable FITR multi-gas spectrometers with salient characteristics were conducted by the Contract Specialist (KS). KS also researched required Government sources including GSA, Unicor, and AbilityOne. FPDS contracts were examined and PCF cabinet searches were made for previous buys and similar products. KS contacted potential manufacturer, who confirmed that product specifications were patented and only available commercially through their company.

The manufacturer confirmed that multiple resellers and distributors were available who were small businesses. This will be solicited as a small business set-aside with brand-name restriction.

CTD chemists are continually researching sources of information and services to enable the CTD field referee group to conduct effective and reliable chemical testing. Market research consists of internet research, literature reviews, discussions with vendors, participating in industry events, virtual trainings and conferences, and other professional resources. If the CTD identifies a similar capability, every effort will be made to compete it to the maximum extent possible.

8. Other Facts: A Sources Sought Notice was posted on SAM.gov, with several small business vendors responding.
