Memorandum for Record – Limiting Competition at or below the Simplified Acquisition Threshold
1. Contracting Activity: U.S. Army Medical Research Acquisition Activity (USAMRAA), 808 Shreider Street, Fort Detrick, MD 21702-5014
2. Description of Action: The purpose of this requirement is for a comprehensive Preventative Maintenance Service contract that incorporates both hardware and software services for USAMRIID’s Hamilton NGS Star Liquid Handling Robot (SN:D922). This is a Government owned item of equipment currently being employed by our Molecular Biology branch which, handles a substantial amount of genomic analysis and time-consuming assays in the ongoing research and development of therapeutics and other disease fighting compounds. The requirements are 1) The contractor must provide preventative maintenance and repair for all hardware within a prescribed timeframe to ensure full operability, and to mitigate potential delays resulting from maintenance shortfalls, and 2) the contractor must provide equipment software maintenance and software updates on an “As Needed” basis to ensure full functionality and operability of the equipment. The contracted service will be performed at USAMRIID, Fort Detrick, Maryland.

5. Reasons for Authority Cited:
USAMRIID currently has a contract in place (W81XWH-21-F-0183) with Goldbelt Frontier LLC which, subsumes the Hamilton NGS Star Liquid Handling Robot for the requisite preventative maintenance and services. However, Hamilton Company has proprietary ownership of the software, the contractor is restricted to servicing only the hardware aspects of the equipment for which, the contract leverages Hamilton Company as a third-party vendor to execute the hardware maintenance. As a result, the equipment has not had a software update/maintenance since the machine was installed and the warranty expired on 10 January 2024. This lack of software maintenance has significantly degraded the instrument’s functionality. Establishing a contract with Hamilton Company will streamline the currently fragmented service requirements, afford access to proprietary software updates and services, while conserving Government resources in a fiscally constrained operational environment.
6. Publicizing Contract Actions:
The public display and synopsis requirements of FAR 5.101 and FAR 5.203:

7. Market Research:
Market Research conducted in accordance with FAR Part 10 was multifaceted and was undertaken to ascertain 1) if the requirement meets the FAR definition of a Commercial Service and 2) if two or more small businesses exist that can meet the Government’s requirement.
Market Research examined if the required services met the FAR definition of a commercial service, which is services of a type offered and sold competitively in substantial quantities in the commercial marketplace. Market Research determined that the required service could be procured as a commercial service, and therefore does meet this definition and is commercially available; thus, standard commercial terms and conditions will apply.
USAMRIID representatives are aware that the marketplace for such services is limited by the number of companies that could potentially respond to this requirement. USAMRIID is not aware of any laws or regulations unique to this service. They are not unaware of available services that require recovered materials and that are energy efficient and there are no accommodations that need to be considered for entry into the service location. Based on our assessment the typical standard service timeframe for this requirement is three (3) to five (5) years.
