About this file

This Justification and Approval (J&A) document details a non-competitive procurement by the Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst for three Maintenance, Crane, Towable 1500 lb. Capacity units (P/N 9319-011) in support of the H-60 Foreign Military Sales (FMS) program for the Spanish Armada. The total estimated procurement value is $324,200, using FY25 FMS funding, with Columbus Jack Corporation identified as the sole source due to proprietary technical data rights.

The J&A justifies limited source competition under 10 U.S.C. 3204(a)(1), noting that Columbus Jack Corp. is the original designer and manufacturer, and their authorized distributor Dutch Valley Supply Co. is the only source capable of providing the item. Market research, including internet searches and a Sources Sought notice on SAM.gov, confirmed no alternative vendors. The document emphasizes that reverse engineering would cause an unacceptable 30-month delay in fulfilling Fleet requirements, potentially impacting maintenance capabilities for FMS partners.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ.

2. Description of the Action Being Approved

This Justification and Approval authorizes and approves on limited source competition basis a contract to Columbus Jack Corporation, CAGE Code 00994, and Dutch Valley Supply Co., CAGE Code 31068, for the procurement of Maintenance, Crane, Towable 1500 lb. Capacity, P/N 9319-011. This effort is in support of the H-60 Foreign Military Sales (FMS) program for the Spanish Armada.

3. Description of Supplies/Services

This action is for the procurement of three (3) each Maintenance, Crane, Towable 1500 lb.

Capacity, P/N 9319-011. This item is required in support of the H-60 Aircraft. The Utility Crane, Towable 1500 lb. capacity permits scheduled and unscheduled maintenance of large, heavy, or bulky components of the H-60 aircraft that, due to location or weight, cannot be lifted manually.

The total estimated value of this procurement is $324,200. The type of funding planned for this acquisition is FY25 FMS funding.

4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 3204(a)(1), From a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency.

5. Rationale Justifying Use of Cited Statutory Authority

Columbus Jack Corp., as the designer, developer, and manufacturer of the required item identified in Paragraph 2, owns the proprietary data and as such is the only source capable of manufacturing this item, which they distribute through their authorized distributor Dutch Valley Supply Co. Columbus Jack Corp. possesses the data rights and technical data package for this

J&A No. 25-0085 effort and is not willing to sell this data to the Government. The Government contacted Columbus Jack Corp. via email on 13 MAY 2025 and Columbus Jack Corp. confirmed that the technical data is proprietary and will not be provided to the Government or sold for manufacture by another party. The required item is only available from Columbus Jack Corp.

and their authorized distributor Dutch Valley Supply Co., and award to any other source would require the need to reverse engineer the item. Based on historical data associated with this item, the reverse engineering effort would result in an estimated thirty (30) month delay as follows: non-recurring engineering eighteen (18) months; development of a technical drawing package twelve (12) months. This additional time would present an unacceptable delay in fulfilling Fleet requirements for delivery schedule that is not expected to be recovered through competition and would result in issues with organizational level of maintenance and the inability of the FMS Partners to support their H-60 Aircraft in the same manner as the United States Navy.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

In accordance with FAR Part 10, market research was conducted by the requirements office to determine the most suitable approach for this acquisition. Market research included internet searches conducted by the NAWCAD H-60 Engineering team to determine whether any other vendors could satisfy the H-60 FMS requirements. The NAVAIR Office of Small Business Programs Website, Dynamic Small Business Search, and Google internet search engines were queried for potential sources. No additional sources other Columbus Jack Corp. and Dutch Valley Supply Co. were identified, confirming Columbus Jack Corp. and Dutch Valley Supply Co. are the only sources capable of meeting the requirement.

In accordance with Department of Defense FAR Supplement 206.302-1, and in an effort to identify possible sources for this requirement, NAWCAD posted a Sources Sought notice/Request for Information on the SAM.gov website on 06/04/205 and one response was received. BHPE, LLC contacted the Government via email to express the vendor’s interest in the opportunity. In its response to BHPE, the Government re-stated the rationale for the limited competition nature of the effort and its intent to issue a solicitation directly to the OEM and its sole authorized distributor; no further communications were received from BHPE.

As required by FAR 5.203, the proposed contract was synopsized on the SAM.gov website from 05/14/2025 through 05/29/2025. No responses were received. Any responses received prior to contract award will be evaluated by the Contracting Officer.

7. Determination of Fair and Reasonable Cost

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in paragraph 5, NAWCAD has no plans at this time to further compete future efforts for the items covered by this J&A. If another potential source emerges, NAWCAD will assess whether competition for future requirements is feasible.
