About this file

This document is a Justification and Approval (J&A) for a sole source contract renewal for Getwell Network software maintenance and support services at the W.G. (Bill) Hefner VA Medical Center in VISN 6. The incumbent contractor, Getwell Network, provides proprietary software, maintenance, and clinical support services that are not available from other vendors. The existing infrastructure is configured solely for Getwell Network products, and replacing it would result in significant duplication of costs, estimated at $4 million, and require at least one year to implement. The contracting office conducted market research and identified at least four Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) as resellers of the required Getwell Network products and services. The contract was awarded to THUNDERCAT TECHNOLOGY, LLC on 2024-08-29 for $183,085.57.

5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in paragraph 8, limited competition is available among resellers for the required brand-name GWN software renewals and associated clinical support and additional licenses. Currently at W.G. (Bill) Hefner VA Medical Center in VISN 6, GWN infrastructure is installed and setup to support Veterans for patient care. It provides information to inpatients (and in limited cases outpatients) about their condition, medication, care plan, and educational resources during their hospital stay, allowing inpatients the opportunity to become involved in their care plan. With this current infrastructure, only GWN or a reseller can provide the necessary software maintenance, helpdesk and system maintenance support, and onsite management clinical support because of the proprietary source code required to develop and implement software upgrades, firmware, and updates. Further, the use of any other brand name software would require a complete replacement and redevelopment of the existing infrastructure in place. Existing servers and switches, which currently are deployed throughout the VISN and are currently configured to only work with GWN. Replacing the hardware and infrastructure is estimated to produce duplicative costs of approximately $4 million and would take a minimum of one year to complete followed by other training and implementation activities that would be required to ensure staff operate the system correctly.

6. Efforts to Obtain Competition: Market research was conducted, details of which are in section 8 of this justification. The undersigned VA technical representative determined that limited competition is viable among resellers for the required brand name licenses and services. In accordance with FAR 16.505(a)(4)(iii)(A)(1), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders. Furthermore, in accordance with FAR 5.301, 16.505(b)(2)(ii)(D), and 16.505(a)(4)(iii), the award notice for this action will be synopsized on the Contract Opportunities website and this justification will be made publicly available within 14 days of award.

7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed.

8. Market Research In March 2024, the Contract Specialist conducted market research utilizing the NASA SEWP V GWAC provider lookup tool and identified at least four Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) as resellers of the required GWN software and technical support services and ten total providers across all categories therefore, reasonable competition is anticipated. A Request For Information (RFI) was released on SAM.gov on 6/18/2024. The RFI yielded one response from The Getwell Network, with an indication of three SDVOSB resellers of the product.
