About this file

This is a Justification and Approval (J&A) document for the use of other than full and open competition in federal contracting.

The Naval Sea Systems Command, Southwest Regional Maintenance Center (SWRMC) in San Diego, California is adding one new work item to an existing firm-fixed-price contract (N00024-25-C-4420) with Vigor Marine LLC. The work item is 992-11-019, providing an office trailer for a chaplain in support of the USS SAVANNAH (LCS 28) Fiscal Year 2025 Docking Selected Restricted Availability (DSRA) in Portland, Oregon. Work is scheduled to begin upon authorization, with the availability start date of 13 April 2026 and a 403-day contract duration. Funding is FY25 OPN (TYCOM funded), and pricing was obtained via Contracting Officer's Procurement Action (COPA) from Vigor.

The justification for non-competitive procurement under 10 U.S.C. 3204(a)(1) centers on operational necessity and schedule criticality. The ship undergoes complete shutdown during DSRA, making onboard spaces unsuitable for chaplain services. No alternative U.S. Naval facilities exist in the Portland area. Vigor is the only viable source as the incumbent prime contractor already positioned at the shipyard; introducing a second contractor would create duplicative costs for program management and temporary services while risking schedule delays that could compromise mission readiness. The requirement was previously solicited competitively via Solicitation N00024-25-R-4420 with at least two proposals received. The Contracting Officer determined the cost fair and reasonable based on market research and technical analysis. The J&A was approved by the Administrative Contracting Officer on 28 May 2026.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION

1. CONTRACTING ACTIVITY

The Naval Sea Systems Command, Southwest Regional Maintenance Center (SWRMC), N55236, Contracting Department Code 440A, 3755 Brinser Street, Suite #1, San Diego, CA 92136-5299. Contracting Point of Contact: Dayen. Laguna,

2. DESCRIPTION OF THE ACTION BEING APPROVED:

The proposed contract action adds one (1) new work item at a firm-fixed-price to Vigor Marine LLC (Vigor) under Contract N00024-25-C-4420, awarded in support of the USS SAVANNAH (LCS 28) Fiscal Year 2025 (FY25) Docking Selected Restricted Availability (DSRA).

e. The Governments minimum needs have been certified as complete and accurate by the technical and requirements personnel.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.103-1 this authority applies in those situations where the supplies or services required by the agency are available from only one responsible source, or, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements. This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

Request for Contract Change (RCC) 5N is generated to provide one commercial trailer to serve as a temporary Chaplain office for the entire contract period in support of the USS SAVANNAH (LCS 28) during its Docking Selected Restricted Availability (DSRA) in Portland, Oregon.

This support is a TYCOM operational requirement to provide confidential care, maintain morale, and support mission readiness. The ship is undergoing a complete shutdown of all shipboard spaces and systems, rendering the entire vessel unsuitable for the chaplain's duties.

Furthermore, there are no U.S. Naval facilities in the Portland area that could be used as an alternative. Given the documented stresses on sailors during such periods, providing a confidential, accessible space for the command's spiritual leader is essential for the overall well-being of the crew and their families.

Adding this work item to the existing contract is in the best interest of the Government. The ship is already in its DSRA at Vigor's Portland shipyard, and Vigor, as the prime contractor, is uniquely positioned to provide this service with minimal disruption. Competing this requirement would introduce a second contractor onsite, creating duplicative costs for Program Management and temporary services and posing a risk to the availability's schedule.

The necessary temporary services are currently priced at per day, or for 403 days. While another vendor might offer a trailer for a lower daily rate, that rate would not include the essential support services (power, water, sewage, connectivity) that Vigor is already providing. Soliciting these services separately would result in additional costs and logistical complexity, likely resulting in a higher total price for the Government. Therefore, leveraging the incumbent contractor's existing infrastructure presents the most efficient and cost-effective solution.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY

OFFERORS AS PRACTICABLE:

The requirement was solicited competitively in a coast wide bid via Solicitation N00024-25- R-4420. There were at least two proposals received. The government conducted a technical review of Vigors proposal and found that their proposal was technically acceptable. During this window of maintenance, no other source can satisfy the agencys requirements without a significant impact to the availability completion schedule. An impact to the availability completion schedule would pose a serious risk to mission readiness. It also poses a risk for financial injury to the government due to additional costs with the duplication of support services such as the Project Management office (PMO) and temporary services. Vigor is uniquely positioned to perform the work as the ship is currently in Vigors shipyard undergoing a major dry docking repair period, and it is impracticable for another company to perform these support services in Vigors dry dock concurrently with other ongoing repairs.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The Contracting Officer has determined that the anticipated cost of this acquisition will be fair and reasonable based on analysis of data other than certified cost or pricing data, market research and technical analysis to be conducted pursuant to FAR Part 15. The technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost and subcontractor cost correspond with the expected cost or Independent Government Estimate (IGE).

8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:

While standard procedures would follow the typical competitive solicitation process, it is in the Governments best interest to incorporate and award this critical maintenance work to Vigor in order to meet and support Fleet operational readiness and prevent additional harm to the government by risking further delays. This event was unforeseen and outside normal expectations, making advance planning or forecasting impossible. The Contracting Officer has therefore determined that this course of action represents the most prudent course of action under these exceptional conditions.
