About this file

This is a Justification and Approval (J&A) document for use of other than full and open competition in federal procurement.

The Naval Sea Systems Command, Southwest Regional Maintenance Center (SWRMC) seeks to add one new work item to an existing firm-fixed-price contract (N00024-25-C-4420) with Vigor Marine LLC. The work item is 583-11-006: Rescue Boat Davit overhaul for the USS SAVANNAH (LCS-28) Fiscal Year 2025 Docking Selected Restricted Availability (DSRA). The USS SAVANNAH is currently undergoing maintenance at Vigor's Portland shipyard with a DSRA start date of April 13, 2026. Funding will be provided through FY26 OPN (NAVSEA funded). The contracting activity is located at 3755 Brinser Street, Suite #1, San Diego, CA 92136-5299, with Dayen Lagunas as the contracting point of contact.

The justification cites 10 U.S.C. 3204(a)(1) as implemented by FAR 6.103-1, asserting that supplies or services are available from only one responsible source. The rationale centers on operational necessity: a Planned Maintenance System check identified severe degradation in the davit's core components, resulting in a Category 3 Casualty Report. The Rescue Boat Davit is classified as an operational "Red Line" system, preventing the vessel from getting underway without higher leadership authorization. The complete overhaul requires the original equipment manufacturer and involves Long Lead Time Material. Vigor is uniquely positioned as the incumbent contractor already on-site with necessary equipment (crane) available. The document emphasizes that competitive procurement would require 30 days for solicitation and 60-90 days for award, creating unacceptable delays that would jeopardize mission readiness and incur significant daily costs for extended drydocking. The work was previously solicited competitively via Solicitation N00024-25-R-4420, with at least two proposals received. Cost fairness and reasonableness will be determined through analysis of data other than certified cost or pricing data, market research, and technical analysis per FAR Part 15. The document is signed and approved by all required officials including technical cognizance (Anthony Hayes, Project Manager), requirements cognizance (Alexa Magada, Port Engineer), legal sufficiency reviewer (Office of Counsel), contracting officer, and administrative contracting officer (Preston Carlson, Branch Head).

1. CONTRACTING ACTIVITY

The Naval Sea Systems Command, Southwest Regional Maintenance Center (SWRMC), N55236, Contracting Department Code 440A, 3755 Brinser Street, Suite #1, San Diego, CA 92136-5299. Contracting Point of Contact: Dayen Lagunas,

2. DESCRIPTION OF THE ACTION BEING APPROVED:

The proposed contract action adds one (1) new work item at a firm-fixed-price to Vigor Marine LLC (Vigor) under Contract N00024-25-C-4420, awarded in support of the USS SAVANNAH (LCS 28) Fiscal Year 2025 (FY25) Docking Selected Restricted Availability (DSRA).

e. The Governments minimum needs have been certified as complete and accurate by the technical and requirements personnel.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.103-1 this authority applies in those situations where the supplies or services required by the agency are available from only one responsible source, or, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements. This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.

5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

Request for Contract Change (RCC) 3N was generated to accomplish Work Item 583-11-006, the complete overhaul of the Rescue Boat Davit unit onboard the USS SAVANNAH (LCS 28).

A routine Planned Maintenance System (PMS) check identified severe degradation to the davit's core components, resulting in a Category 3 Casualty Report (CASREP). This work requires the Original Equipment Manufacturer (OEM) to overhaul the entire davit unit, which is considered Long Lead Time Material (LLTM). The urgent nature of this requirement dictates that the OEM material must be ordered no later than to mitigate schedule impacts.

The Rescue Boat Davit is an operational "Red Line" system. As a result of this casualty, the USS SAVANNAH cannot get underway without authorization from higher leadership. This places a significant operational burden on the vessel and severely restricts its mission readiness.

A failure to quickly restore the primary davit system presents an unacceptable risk to the safety of the crew, particularly in a man-overboard scenario.

The ship is currently executing its FY25 Drydocking Selected Restricted Availability (DSRA) at Vigor's Portland shipyard. The removal of the davit requires a crane, and due to the width of an Independence-class LCS, this can only be safely accomplished while the ship is positioned in the drydock. The incumbent contractor, Vigor, already has a crane available, positioned, and ready to use for this specific evolution. If this requirement were solicited to an outside contractor, they would be required to procure and rent their own crane, unnecessarily duplicating costs and logistical efforts.

Furthermore, soliciting this work to another contractor would introduce unacceptable schedule delays and jeopardize mission readiness. Execution of this requirement remained on hold pending confirmation of official "Red Line" CNO availability, sponsor approval, and the receipt of funding for the $1.5M+ requirement, which was obtained on . Execution of a standard competitive procurement requires 30 days for solicitation and 60 to 90 days for award.

As a result, there is insufficient time to execute a competitive award before the OEM material-order deadline required to maintain contractual milestones. Introducing a third party would cause severe disruption to the highly compressed critical path of the DSRA. Any delay to the USS SAVANNAH's completion milestones will prevent the ship, daily rate of from leaving Portland on schedule, incurring significant daily costs for extended drydocking and creating a cascading negative impact on the operational schedules of other fleet assets. Therefore, it is in the Government's best interest to issue a sole-source modification to Vigor to perform this essential work.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY

OFFERORS AS PRACTICABLE:

The requirement was solicited competitively in a coast wide bid via Solicitation N00024-25- R-4420. There were at least two proposals received. The government conducted a technical review of Vigors proposal and found that their proposal was technically acceptable. During this window of maintenance, no other source can satisfy the Agencys requirements without a significant impact to the availability completion schedule. An impact to the availability completion schedule would pose a serious risk to mission readiness. It also poses a risk for financial injury to the government due to additional costs with the duplication of support services such as the Project Management office (PMO) and temporary services. Vigor is uniquely positioned to perform the work as the ship is currently in Vigors shipyard undergoing a major dry docking repair period, and it is impracticable for another company to perform these support services in Vigors dry dock concurrently with other ongoing repairs.

7. DETERMINATION OF FAIR AND REASONABLE COST:

The Contracting Officer has determined that the anticipated cost of this acquisition will be fair and reasonable based on analysis of data other than certified cost or pricing data, market research and technical analysis to be conducted pursuant to FAR Part 15. The technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost and subcontractor cost correspond with the expected cost or Independent Government Estimate (IGE).

8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:

While standard procedures would follow the typical competitive solicitation process, it is in the Governments best interest to incorporate and award this critical maintenance work to Vigor in order to meet and support Fleet operational readiness and prevent additional harm to the government by risking further delays.

This event was unforeseen and outside normal expectations, making advance planning or forecasting impossible. The Contracting Officer has therefore determined that this course of action represents the most prudent course of action under these exceptional conditions.
