About this file
This is a Justification and Approval (J&A) document for use of other than full and open competition in federal contracting. The Naval Sea Systems Command, Southwest Regional Maintenance Center (SWRMC) is adding one new work item to an existing firm-fixed-price contract (N00024-25-C-4420) with Vigor Marine LLC to support the USS SAVANNAH (LCS 28) Fiscal Year 2025 Docking Selected Restricted Availability (DSRA). The work item 446-11-001 involves Ship Alteration LCS2-98089K for an L&S Industrial Antenna installation, which provides a critical upgrade to the ship's Identification Friend or Foe (IFF) system by integrating new hardware and software and replacing older components with higher-performance versions. The work is scheduled to begin upon authorization, with the DSRA availability starting April 13, 2026, and is funded through FY26 OPN (NAVSEA funded).
The justification for single-source award to Vigor is based on 10 U.S.C. 3204(a)(1) and FAR 6.103-1, citing technical interdependence with existing IFF system modernization work already being performed by Vigor. The document emphasizes that introducing a second contractor would create unnecessary complexity, duplicate management efforts, and introduce significant integration risks. A competitive procurement would result in unacceptable schedule delays of 45 to 90 days during dry-docking, incurring contractually mandated daily penalties. The Contracting Officer determined fair and reasonable cost based on analysis of non-certified cost data, market research, and technical analysis with an Independent Government Estimate. The requirement was previously solicited competitively via solicitation N00024-25-R-4420 with at least two proposals received. The J&A was approved by the Contracting Officer on June 1, 2026, and the Administrative Contracting Officer on June 1, 2026.

technical and requirements personnel.
4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION
The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1) as implemented by the Federal Acquisition Regulation (FAR) 6.103-1 this authority applies in those situations where the supplies or services required by the agency are available from only one responsible source, or, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements. This availability is the last opportunity to complete this upgrade prior to deployment and this work is needed to fulfill required operational capability.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY
A Request for Contract Change (RCC) 1N has been generated to accomplish Ship Alteration
(ShipAlt) WI 446-11-001 on the USS SAVANNAH (LCS 28). This ShipAlt provides a critical completely new antenna installation, this effort involves integrating new hardware and software, replacing older components with higher-performance versions to provide the ship with greater warfighting capability.
to perform scheduled baseline modernization tasks on this exact IFF system. The upgrade specified in RCC 1N is technically interdependent with this existing work. Executing this work as a single, integrated effort avoids the inherent risks and inefficiencies of having two different contractors working on the same interconnected system. Introducing a second contractor to perform a closely related scope of work would create unnecessary complexity, duplicate program management and oversight efforts, and introduce significant integration risks.
Because Vigor is already mobilized, equipped, and actively modernizing the IFF system, they are uniquely positioned to execute this upgrade immediately. A portion of this effort, the removal of existing equipment, must be performed while the vessel is in dry dock to ensure proper crane access. Introducing a separate contractor would halt this critical-path work and introduce an unacceptable schedule delay of 45 to 90 days. Per Section J of contract N00024- 25-C-4420, delays to the dry-docking schedule incur a contractually mandated penalty of per day. Consequently, a competitive procurement would result in substantial, unrecoverable duplicative costs to the Government ranging from (45 days x
) to (90 days x ) in daily delay penalties alone, with no expectation best interest to award this work to the incumbent.
6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY
OFFERORS AS PRACTICABLE:
The requirement was solicited competitively in a coast wide bid via Solicitation N00024-25- R-4420. There were at least two proposals received. The government conducted a technical review of Vigor During significant impact to the availability completion schedule. An impact to the availability completion schedule would pose a serious risk to mission readiness. It also poses a risk for financial injury to the government due to additional costs with the duplication of support services such as the Project Management office (PMO) and temporary services. Vigor is uniquely positioned to perform the work as the ship is currently in Vigor shipyard undergoing a major dry docking repair period, and it is impracticable for another company to perform these support services in Vigor
7. DETERMINATION OF FAIR AND REASONABLE COST:
The Contracting Officer has determined that the anticipated cost of this acquisition will be fair and reasonable based on analysis of data other than certified cost or pricing data, market research and technical analysis to be conducted pursuant to FAR Part 15. The technical analysis will be performed with the Project Manager to ensure the proposed labor hours, material cost and subcontractor cost correspond with the expected cost or Independent Government Estimate (IGE).
8. ACTION TAKEN TO REMOVE BARRIERS TO COMPETITION:
While standard procedures would follow the typical competitive solicitation process, it is in
Vigor in order to meet and support Fleet operational readiness and prevent additional harm to the government by risking further delays. This event was unforeseen and outside normal expectations, making advance planning or forecasting impossible. The Contracting Officer has therefore determined that this course of action represents the most prudent course of action under these exceptional conditions.
