About this file
This Justification and Approval (J&A) document from the Naval Air Warfare Center Aircraft Division (NAWC-AD) authorizes a sole-source procurement from Dutch Valley Supply Co. for an E-2D Advanced Hawkeye (AHE) Integrated Navigation, Control, and Displays Systems (INCDS) Pedestal Tool Set. The acquisition includes twenty-one (21) specialized maintenance tools for assembly, disassembly, and repair of the E-2D INCDS Pedestal Assembly, along with five training events at Fleet Readiness Center Southwest.
The procurement is valued at $700,000 for Fiscal Year 2023, with Safran Electronics and Defense Avionics LLC identified as the Original Equipment Manufacturer (OEM). The J&A justifies the sole-source selection based on Safran's exclusive ownership of the technical data package and Dutch Valley being the only authorized distributor. Market research and a Sources Sought Notice confirmed no alternative vendors could meet the requirement, and attempting to qualify an alternate part number would cause an 18-24 month delay in depot readiness, potentially impacting aircraft mission capabilities.

DEPARTMENT OF THE NAVY
NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION
J&A Number: 25-0061
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Actions Being Approved.
This Justification and Approval (J&A) authorizes and approves, on a sole source basis, the procurement of the E-2D Advanced Hawkeye (AHE) Integrated Navigation, Control, and
Displays Systems (INCDS) Pedestal Tool Set and training to Dutch Valley Supply Co. (Dutch
Valley), Lawrenceville, Georgia (CAGE: 31068). The Pedestal Tool Set is required to support the E-2D AHE INCDS Pedestal Assembly.
3. Description of Supplies/Services.
This acquisition is for one (1) E-2D AHE INCDS Pedestal Tool Set consisting of twenty-one (21) individual tools. These maintenance tools are used for the assembly, disassembly, and repair of the E-2D INCDS Pedestal Assembly. The tools shall be delivered in a storage case. Dutch Valley shall also conduct five (5) training events at Fleet Readiness Center South West (FRCSW) that will cover topics on assembly, disassembly, repair, inspection, and cleaning of the Cockpit
Control Pedestal Part Number (P/N) 5L5025-301 utilized on the E-2D AHE aircraft.
Estimated Dollar Value
FY23 Total
Aircraft Procurement, Navy-1 $700K
Total $700K
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority:
Safran Electronics and Defense Avionics LLC (Safran) (CAGE: 86831) is the Original
Equipment Manufacturer (OEM) of the E-2D AHE INCDS Pedestal Tool Set. The tool set is
J&A No. 25-0061 specifically designed to meet the form, fit, and function of the E-2D AHE INCDS Pedestal
Assembly. Safran is the only source with the requisite knowledge, experience, technical expertise, and source data for the INCDS Pedestal Assembly and associated tool set. Safran owns the technical data package (TDP) for the INCDS Pedestal Assembly and Tool Set, which is required for this effort. Safran is not willing to provide the TDP to the Government or any other contractor other than their sole authorized distributor, Dutch Valley (CAGE: 31068). No other contractor can complete this requirement without Safran’s proprietary data. In an email dated 8 May 2024, Safran directed the Government to process the procurement for the Pedestal
Tool Set through Dutch Valley, and supplied a Military Distribution and Authorization Letter, dated 17 January 2024. The Distribution and Authorization Letter indicates that Dutch Valley is the only authorized distributor for new military part orders and repair efforts.
In addition, qualifying an alternate part number for the E-2D AHE INCDS Pedestal Assembly would severely impact fleet readiness and effectiveness and potentially reduces the number of aircraft ready to perform their mission at a given time. This would result in an unnecessary schedule delay of approximately eighteen (18) to twenty (24) months in order for another vendor to design and test the tools, which would be excessive to the Government due to the depot standup requirement schedule.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market Research and internet searches were conducted by the Government’s technical team to determine if any other vendor could satisfy the U.S. Navy’s requirements. The Federal
Procurement Data System, Haystack, One Touch and WebFLIS internet search engines were queried for potential sources without success. Results indicated that Dutch Valley was the only known source capable of meeting the requirement.
The Sources Sought Notice required by Defense Federal Acquisition Regulation Supplement
206.302-1(d) was published on the SAM.gov website 8 August 2024 through 13 August 2024.
One (1) inquiry was received from BHPE LLC (BHPE) (CAGE: 9SWS7). The Government technical team reviewed BHPE’s submittal and confirmed they could not technically provide the requirement as BHPE is not an authorized distributor of Safran. The Contract Specialist responded to BHPE in writing on 5 September 2024, and no additional inquiries were received.
In accordance with FAR 5.201(b)(1), this requirement was synopsized on SAM.gov website on
9 October 2024 through 24 October 2024. No responses were received.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
This is intended to be a one-time procurement. NAWC-AD Lakehurst has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAWC-AD Lakehurst will assess whether competition for future requirements is feasible.
