DEPARTMENT OF VETERANS AFFAIRS

FAR 8 – Justification for Limiting Sources (LSJ) For

Limiting Sources (<SAT)

Acquisition Plan Action ID: 36C244-21-AP-5194

1. Contracting Activity: Department of Veterans Affairs, VISN 04, James E. Van Zandt VA Medical Center, Altoona, PA – 2237# 595-21-4-5477-0638

2. Description of Action: The Lebanon VA Medical Center is requesting the sole source modification to delivery order 36F79720D0109 36C24421F0291 for the provision and installation of 76 new Handicare SR Weigh scales (patient scales) for the Handicare manual traverse C-625 lifts currently being installed.

Order against: FSS Contract Number: 36F79720D0109

Name of Proposed Contractor: Handicare USA, Inc Street Address: 10888 Metro Ct City, State, Zip: Maryland Heights, Mo, 63043

3. Description of Supplies or Services:

The Lebanon VAMC has a need for 76 Handicare SR Weigh scales for use with the new Handicare C-625 patient lifts currently being installed at the facility. Handicare is currently on-site at the Lebanon VAMC installing the new C-625 ceiling lifts awarded on the original order, 36C24421F0291.

4. Authority:

ORDER AGAINST FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Mark the applicable exception:

VHAPM Part 808.405-6 Limiting Sources Page 2 of 3 Original Date: 08/30/2017 Revision 01 Eff Date: 04/23/2018

An urgent and compelling need exists, and following the procedures would result in unacceptable delays(FAR 8.405-6(a)(1)(i)(A);

Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

(FAR 8.405-6(a)(1)(i)(B));

In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole-source or limited-sources procedures (FAR 8.405- 6(a)(1)(i)(C)); or

Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)).

5. Rational/explanation to support cited authority:

Order 36C24421F0291 was awarded to Handicare USA in April 2021 for the supply and installation of 163 C-625 patient lifts that had surpassed their useful lives and had become unsafe. Upon the arrival of the installation crew in late August, an issue was identified with the existing patient scales which were intended to be used with the new lifts. With product updates made to the new C-625 lifts, including a re-design of the carry bars, it was determined the existing patient scales are over 20 years old and incompatible with the re-designed carry bars, making the lifts unusable. It was unknown at the time of original award that the patient scales would be incompatible, and their replacement was not included in the original requirement. These scales are a crucial requirement in order to allow hospital staff to accurately and safely record patient weight. The scales needed are peculiar to the Handicare C-625 patient ceiling lifts. The vendor is currently on-site completing lift installation and is capable of providing the needed scales with little additional down time required. Should the additional time be taken to solicit for and award a new requirement for the replacement of the scales, there would likely be a lengthy downtime required for a new vendor to come in and perform the replacement. The new carry bar design is a peculiar feature of the Handicare C-625 patient lifts, and there are limited vendors that could perform the work. Handicare is the manufacturer and currently has technicians on-site, allowing for not only cost savings, but decreased downtime of the critical patient lifts.

6. BRAND NAME ONLY: This buy is estimated to exceed $25,000 and this documentation will be posted as required.

7. Note that this determination satisfies the requirements of FAR 8.405-6. The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules.
