The sole source justification is based on statutory authority 41 USC §3304(a)(1)—"Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." Panhandle Nuclear Rx LTD is identified as the only nuclear pharmacy in the Amarillo area capable of manufacturing and delivering these radiopharmaceuticals within their limited shelf life requirements. Market research confirmed this finding through searches of UNICOR, Ability One, Purdue University's nuclear pharmacy locator, and the SBA's Dynamic Small Business Search. A synopsis of the proposed acquisition was published on SAM Contract Opportunities (36C25726Q0368) inviting any responsible source to respond; no responses were received. The Contracting Officer determined that anticipated prices will be fair and reasonable by comparing proposed prices to current order prices. Both the Contracting Officer and the Branch Chief of Patient Administrative Support approved the justification on April 28 and April 30, 2026, respectively.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Panhandle Nuclear Rx LTD is the only nuclear pharmacy in the Amarillo area that can manufacture and deliver the requested radiopharmaceuticals within their limited shelf life period. Accordingly, Panhandle Nuclear Rx LTD is the only firm capable of providing the supplies and services described in Section 3 above without the Veteran’s Health Administration experiencing unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as possible (including whether a notice was or will be publicized as required by RFO Part 5 and, if not, which exception under RFO Part 5 applies):

A notice of intent to sole source was published on SAM Contract Opportunities for this requirement under 36C25726Q0368. The notice stated that any responsible source could respond to the notice and shall be considered by the agency. The response date of the notice passed and there was no response to the notice.

7. Determination by the CO that the Anticipated Cost to the Government will be

Fair and Reasonable:

The Contracting Officer has determined that the anticipated prices will be fair and reasonable. The proposed prices will be compared to the current order prices.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:

A search of the mandatory sources for supply procurements, UNICOR and Ability One, identified that they do not offer radiopharmaceuticals. A search using Purdue University’s nuclear pharmacy locator identified that Panhandle Nuclear Rx LTD is the only nuclear pharmacy in the Amarillo area. A search using the SBA’s Dynamic Small Business Search identified that there is only one, Panhandle Nuclear Rx, small business nuclear pharmacy in the Amarillo area. As described in Section 6 above, market research, in accordance with RFO Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

None

11. A Statement of the Actions, if any, the Agency May Take to Remove or

Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

Market research will be conducted prior to exercising the option and subsequent to any other acquisition to identify if there has been any changes in the marketplace.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
