About this file
This justification and approval document outlines a sole source contract award to Pac Tech USA Packaging Technologies Inc. The Federal Bureau of Investigation requires discs, spacer rings, and capillaries of various dimensions as replacement parts for its Pac Tech laser-assisted solder ball placement system. As the sole distributor of these products in the United States, Pac Tech is uniquely qualified to meet the FBI's needs. A notice of intent to sole source was posted on SAM.gov to allow for expression of interest from other vendors, though Pac Tech confirmed it has no authorized resellers. The FBI conducted market research including internet searches and contacting technical staff and manufacturers but did not identify any alternative suppliers. The Department of Justice awarded contract 15F06724P0000514 to Pac Tech USA Packaging Technologies Inc. on March 4, 2024 for $13,881.92 to acquire the required replacement parts.

FEDERAL BUREAU OF INVESTIGATION
FINANCE and FACILITIES DIVISION | PROCUREMENT SECTION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND
OPEN COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41
U.S.C. 3304 (A) (1)
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisition Programs Unit (NAPU), has prepared this justification for other than full and open competition for Pac Tech Replacement Parts on behalf of the Operational Technology Division (OTD).
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The government intends to award a one-time, firm fixed price, sole source Purchase Order to Pac Tech USA Packaging Technologies, Inc., Address: 328 Martin AVE, Santa Clara, California 95050-3112, United States.
3. A description of the supplies or services required to meet the agency’s needs.
The requirement is to provide discs, spacer rings, and BH6 capillaries of various required dimensions. The Pac Tech laser-assisted solder ball placement system (“reballer”) enables the FBI to quickly, precisely, and reliably attach solder balls/spheres to integrated circuit packages.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304 (a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Pac Tech is uniquely qualified for this acquisition because they are the sole source distributer in the US of the required products. The items specifically being procured are utilized in the SB2 system, which is a unique, patented system only supplied by Pac Tech. Such items allow running different ball sizes on the tool. The Pac Tech reballer uses the latest technology available and can handle the smaller ball and pitch sizes that will undoubtedly be encountered in future electronic devices. The Pac Tech SB2-M reballer can reliably and repeatedly dispense ball sizes as small as 6 mils (0.006”) with a pitch as small as 0.18 mm. These reballer items are direct replacement parts for the reballer system, a machine currently in use. No other brand’s parts will seamlessly integrate into the current products. Since Pac Tech has no authorized resellers, this is a sole source requirement.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
This procurement will be announced via SAM.gov as a Notice of Intent to Sole Source. The NOI will give ample time for potential vendors to express interest; however, Pac Tech has confirmed that they have no authorized resellers.
8. A description of the market research conducted and the results.
Internet searches were conducted for the sought-after products; no providers other than Pac Tech were discovered. The manufacturer was contacted and confirmed that there are no authorized resellers for these products. These products were also not found on GSA Advantage or NASA SEWP. Technical individuals within the FBI were also contacted to learn of any new sources for the machine’s parts, and none were found.
Pac Tech USA Packaging Technologies, Inc has an active SAM registration and is a small business. They were contacted during Market Research to provide a quote for these products as well.
9. Any other facts supporting the use of other than full and open competition.

10. A listing of any sources that expressed a written interest in the acquisition.
As Pac Tech is the sole distributer of these products, no other vendors were contacted to provide these products. To ensure that there is fair competition, an NOI will be posted to allow other vendors the opportunity to express if they have those capabilities; however, the manufacturer has stated that there are no authorized resellers and provided a sole source letter.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of FFD to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. The market will continue to be monitored. Over time, additional sources may become available and identifiable through market surveys, trade shows, collaboration with other Federal agencies, or other means.
