SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5

Nature and/or Description of the Action Being Processed:
This is an individual brand-name justification to support the procurement of the following items:
AUTOBAG, SHARP OEM, FANFOLDED 12IN X 14.75IN X 0.0025 HD MAILER
QTY: CS
Description of Supplies/Services Required to Meet the Agency’s Needs:
This bag is fan-folded and has 1 side open. The prescriptions are dropped into the bag and it feeds through the system and it seals the bag and puts the mailing label on to the bag to be sent out to the veteran. The Station requires 1 cases delivered ever week for a total amount of cases The value of the contract $ .00
Statutory Authority Permitting Restricted Competition:
FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:
( ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements Because this is a “Brand Specific” Need.

We use the same bag the Government cannot hold the contractor accountable if they do not meet the testing standard of 80,000 prescriptions per hours. We can’t swap out any product they are already using until the testing phase is over and we have accepted the equipment.
Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This will be posted on Contract Opportunities (beta.SAM.gov) as a full and open competion amongst all authorized of the MFR .
Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
