About this file

This is a Justification and Approval (J&A) document for other than full and open competition procurement authority for the Department of Veterans Affairs.

The Department of Veterans Affairs, NCO 10 at Dayton VA Medical Center seeks approval to solicit a Tridium HVAC control panel on a brand name only basis for Project #552-21-102 (Stabilize/Improve Building 120 - Putnam Library), referenced in Division 23, 23 09 23. The contracting activity is identified as 2237: 552-26-3-6945-0006, with Acquisition Plan Action ID 36C250-26-AP-1043. The justification cites 41 USC §3304(a)(1) as the statutory authority for single-source procurement, asserting that only one responsible source exists and no other supplies or services will satisfy agency requirements. Tridium panels possess proprietary communication protocols designed exclusively for use with other Tridium products and are already deployed throughout the DVAMC campus. The agency determined that interchanging HVAC panel manufacturers in the existing network would result in system failures, making Tridium mandatory to interface with the current HVAC DDC system and maintain network functionality. The Contracting Officer certified that anticipated costs to the government will be fair and reasonable based on commercial marketplace pricing, though no formal market research was conducted. The document specifies that future solicitations for similar requirements will utilize "brand name or equal" language where feasible, though the current requirement necessitates brand name specification due to fire protection network compatibility requirements. Historical Engineer Gregory Hopper and Contracting Officer Jenessa Regan provided required certifications on April 13 and 15, 2026, respectively.
