About this file

This document is a justification for a sole source award of a 12-month contract. The Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 4 requires a contractor to continue providing emergency residential placement and treatment services through its Healthcare for Homeless Veterans program in Philadelphia, Pennsylvania. The incumbent contractor, Fresh Start Foundation, will provide services in two residential programs housing 45 homeless veterans with mental illness, substance abuse disorders, and medical conditions. The contractor must rapidly stabilize veterans and place them in transitional or permanent housing within 30 to 90 days, but no more than 180 days. The estimated value of the sole source contract awarded to Fresh Start Foundation is $2,684,610.00 for the 12-month period to avoid interruption of services until the new long-term contractor under IDIQ contract 36C24424D0035 can fully transition veterans.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C244-24-AP-1160 Healthcare for Homeless Veterans (HCHV) Philadelphia VA Medical Center

1. Contracting Activity: Department of Veterans Affairs, VISN 04, Corporal Michael J.

Crescenz VA Medical Center (CMCVAMC) HealthCare for Homeless Veterans Program

2. Nature and/or Description of the Action Being Processed: The purpose of this contract is to obtain a contractor who can provide care, and rehabilitation services to Veterans experiencing homelessness, including Veterans diagnosed with severe mental illness and substance use disorders.

This contract is for a 12-month IDIQ for the estimated amount of $2,684,610.00. The current contract ends 12/30/2023 and a new award is needed to avoid interruption in services while transitioning to housing Veterans with the new 10-year IDIQ contract.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The VA has been providing direct and specialized services for homeless Veterans for nearly 25 years. The Secretary of the VA has set a zero-tolerance policy for homelessness within the Veteran population. As part of the Plan to End Homelessness among Veterans announced in late 2009, the Veterans Health Administration (VHA) has been increasing both capacity of existing programs and services offered to program participants. The plan calls for utilizing new models of care not previously offered by VA.

CMCVAMC needs a Contractor to continue to provide emergency residential placement and treatment services through the Health Care for Homeless Veterans (HCHV) program. The contract will serve a total 45 homeless Veterans in two separate programs who need immediate placement in a safe environment with onsite treatment services. Many of these veterans have co-morbid conditions that include serious mental illnesses, substance abuse disorders, and other serious medical conditions. The goal of the HCHV Contracted Residential Services (CRS) is to rapidly stabilize Veterans’ medical, mental health, substance abuse and other psychosocial problems in order to place Veterans in other appropriate transitional or permanent housing within 30 to 90 days, but no more than 180 days.

Contractor will provide rapid placement of VA-referred Veterans in a safe, residential treatment setting while addressing Veterans’ complex needs through on-site treatment case management services. This housing must meet the criteria established both by HCHV clinical staff and VA fire and safety officials.

4. Statutory Authority Permitting Other than Full and Open Competition: .

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( x ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The time it would take to solicit and award a new contract is not in the best interest of the Government.

It would not be conducive to interrupt services and switch to another vendor prior to the new contractor being able to accept Veterans for placement after a build-up and transition period.

The new 10-year IDIQ contract has been awarded, however unforeseen issues with inspections is delaying admissions. The 12-month contract will be needed to avoid lapse in coverage.

Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: In accordance with FAR 6.302-2 Unusual and compelling urgency, it would not be conducive to interrupt services and switch to another vendor prior to the new long-term contract transition period. Market research was conducted on the incumbent for performance and there is no reason to believe that the incumbent will not be able to continue satisfactory or higher services. Market research from the new 10-year IDIQ award for the same services, conducted in 2021-present was also reviewed and found to be applicable to this sole source award.

Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The incumbent had slightly increased pricing from th contract ordering period that expired 9/30/2023. The rate of $155 per Veteran per day estimated is the same as the contract 36C24423D0133 was determined fair and reasonable at the time of award based off the average census, rise in salaries, and rise in prices over the last few years. The

$1 considers

Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Due to the urgency of award and a need for continued services without interruption, extensive market research was not conducted.

The basis for a sole source contract to the existing contractor in this situation is to continue for a 12-month period until the new long-term contractor can be ready to accept and house Veterans.
