About this file
This document is a Justification and Approval (J&A) for a sole source award under simplified acquisition procedures for Oshkosh OEM training services. The 4ID (4th Infantry Division) is seeking a firm-fixed-price contract to provide Oshkosh OEM training to 4ID mechanics to develop their troubleshooting and maintenance skills on Oshkosh vehicle platforms. The total estimated value is $550,000 for the period of 30 September 2024 to 29 September 2025. Oshkosh Defense, LLC is the only source capable of providing this specialized OEM training, as they are the original manufacturer of the vehicle platforms. Market research confirmed there are no other qualified sources. A Sources Sought notice was posted, but only Oshkosh responded. The contract is a follow-on to a previous sole source award. If the J&A is not approved, it would result in a break in service that would impact the 4ID's ability to maintain and repair their Oshkosh vehicles.

FAR 13.5 Simplified Procedures for Certain Commercial Items Sole Source Justification and Approval
1. Contracting Activity: 918th Contracting Battalion/MICC Fort Carson
2. Description of Action: 4ID G4 (Maintenance) requests a firm-fixed-price contract. The Government projects award for September 2024 and fiscal year 2024 Operation and Maintenance funds to be used.
a. An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
b. This action is a follow-on to contract W911RZ-23-P-0065. That contract was not competed under authority 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.5. Paragraph 7., “Actions to Increase Competition” of the previous justification, stated: The highly specialized nature of the equipment does not facilitate the use of full and open competition sourcing. Technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition were not developed or are not available as Oshkosh Corporation has been the single source of maintenance and manufacturing support since Oshkosh Corporation developed vehicle platforms for the Army. Those actions were accomplished due to highly specialized nature of the equipment, technical data, packages, specifications, and engineering. A Sources Sought was published on SAM.gov for Oshkosh OEM Training which yield no results. Previous J&A is attached.
3. Description of Supplies/Services: The service provided will included representatives from the Oshkosh Defense, LLC who will provide Original Equipment Manufacturer (OEM) training to develop troubleshooting and maintenance skills of 4ID Mechanics.
These services allow 4ID and Fort Carson Units to refresh skills and gain better knowledge on Oshkosh equipment. The contract will provide multiple blocks of instruction throughout the fiscal year: IAW the Oshkosh training outline and training modules requested by 4ID, training 12 students per class, (48 per 30-day block) with two instructors.
Estimated total of
Period of Performance 30 September 2024 to 29 September 2025.
4. Authority Cited: Simplified Procedures for Certain Commercial Items, Title 41 U.S.C.
1901.Only one responsible source and no other supplies or services will satisfy agency requirements.
CUI//SP-PROCURE//FEDCON
5. Reason for Authority Cited:
a. Oshkosh Defense, LLC is the only provider of the Oshkosh Original Equipment Manufacturer (OEM) training on the Oshkosh vehicle platforms. No other manufacturer or agency has the capability, knowledge, and resources to support the requirements.
Additionally, Oshkosh Corporation is the company that originally developed the system for the Army. This is a commercial service acquisition being awarded using Simplified Acquisition Procedures in accordance with FAR Part 13. The acquisition if for $550,000.00 under the Simplified Acquisition Procedures threshold. Market research was conducted in accordance with FAR Part 10 and FAR Part 8, Mandatory Sources. Market research revealed that there are no mandatory sources that can support this requirement.
b. Alternatives: Currently, there are no other alternatives. Oshkosh Defense LLC is the only source available to provide training on Oshkosh manufactured equipment to 4ID mechanics. Oshkosh Defense LLC do not have any distributors.
c. Additional Supporting Information: The current contract W911RZ-23-0065 period of performance ends 29 September 2024. To prevent a break in service, the follow-on contract period of performance will begin 30 September 2024.
d. Impact if justification not approved: If this J&A is not approved, there would be a break in service which would have an impact on 4ID mechanics receiving the required training needed to repair vehicles especially during deployments.
e. Efforts to Obtain Competition: On 4 August 2024, a Sources Sought Notice (SSN) was posted on SAM.gov; as result, Oshkosh Defense LLC, was the only source capable to perform the training. The Contracting Officer shall publish the notices required by
FAR 5.201.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by
FAR 5.201.
7. Actions to Increase Competition: The highly specialized nature of the equipment does not facilitate the use of full and open competition sourcing.
8. Market Research: There are no other qualified sources after conducting market research. Oshkosh Corporations is the only source for the Original Equipment manufacturing (OEM) and repair that exist since they developed their first truck contract for the Army and the Marine Corps in 1976. Previous Contract W911RZ23P0065 was awarded and its sole sourced to Oshkosh for the OEM training which is reference in the market research report.
